한국 로스쿨의 의의와 과제 - ‘로스쿨 시스템’을 로스쿨답게 만들어야 -

이 글은, 그 도입 7년차를 눈 앞에 둔 시점에서, 한국 ‘로스쿨 시스템’ 도입의 과정과 의의를 다시 한 번 되짚어 보고, 현안이 되어 있는 시급한 과제들을 점검해본 것이다. 한국에서의 로스쿨 논의는 1995년 김영삼 정부에 의해 시작되어 김대중 정부에서도 이어졌으나 결실을 맺지 못하다가, 2004년 12월 노무현 정부에 의해 국가적⋅사회적 합의로서 ‘로스쿨 시스템’ 도입의 방침이 정해졌다. 이후 법령화 및 설치인가 과정을 거쳐 2009년 3월에 25개의 로스쿨이 출범함으로써, 한국에서도 ‘로스쿨의 시대’의 막이 올랐다. 한국에서의 ‘로스쿨 시스템’ 도입은 백 년 이상의 역사를 가진 ‘시험에 의한 선발’이라는 법률가양성 제도의 기본원리를 ‘교육을 통한 양성’으로 획기적으로 전환시키는 것으로서 실로 ‘혁명’이라고 불러도 좋을 사건이다. ‘21세기의 법치국가를 뒷받침할 장래의 법조인’을 양성하기 위해 도입된 ‘로스쿨 시스템’은, 이미 다양한 출신과 전공과 경험을 가진 법률가의 배출, 새로운 법률가 직역의 개척, 법률가의 지역간 균형 확대, 경제적⋅사회적 약자의 법률가 진출 증대 등의 성과를 거두고 있고, 앞으로 더욱 많은 성과를 낼 것으로 기대된다. 한편 한국 ‘로스쿨 시스템’은 여전히 해결하지 않으면 안 될 중요한 과제들도 안고 있다. 달리 유례를 발견할 수 없는 총입학정원 제도의 폐지와 ‘정원제 선발시험’으로 운용되고 있는 변호사시험의 자격시험화가 무엇보다 시급한 과제이다. 또한 경제적 약자를 위한다는 미명 아래 과거로 돌아가자고 하는 ‘예비시험 도입’ 혹은 ‘사법시험 존치’ 주장에 대처하는 것도 과제이다. ‘로스쿨 시스템’을 진정으로 로스쿨답게 만들기 위해 모두가 함께 지혜를 모음으로써, ‘21세기를 위한 새로운 법률가양성 제도’의 성공적인 안착을 위해 함께 노력하는 것이 긴요하다.
Abstract
This paper examines the process, meaning and pending issues of the Korean law school system. The 'law school discussion' in Korea started by the Kim Young Sam government in 1995, and continued during Kim Dae Jung government without result. In December 2004, Roh Moo Hyun government decided to introduce the law school system based on the national agreement. The law school era in Korea began in March 2009 with the launching of 25 law schools. The introduction of the law school system in Korea is worthy of being called a 'revolutionary occurrence', in that it aims at an epoch-making change of the basic principle of legal education and training from 'selecting by examination' to 'training through education'. The Korean law school system for training the lawyers in the 21st century, has already accomplished and is expected to accomplish a great deal in producing the lawyers with various skills and experiences, developing new fields for lawyers, balancing the regional distribution of lawyers and increasing the number of the lawyers with economically weak background. On the other hand, there are important issues to be solved in Korean law school system. It is necessary to abolish the control over the total number of law school students, which is unparalleled in the whole world. It is necessary to make the bar examination 'a qualifying examination'. And it is also important to cope with the attempt to maintain the national bar examination or to introduce the baby bar examination under the guise of supporting weak people.
