한국 지식재산법제의 발전과 그 국제적 위상- 특허법을 중심으로 -

초록
한국은 1970년대 중반에서 1990년대 중반까지 20여 년의 기간에 산업사회에서 정보(화)사회로의 변혁을 시도하였다. 여기에 1990년대 중반부터 불기 시작한 정보화 물결은 우리 사회를 디지털 세계로 온전히 바꾸어 나갔다. 이런 시대적 사정 하에서 특허법은 산업재산권법의 대표적 법률로 산업발전에 주안점을 둔 입법 취지에 따라 실제 산업계에 커다란 영향을 끼쳤다. 1990년대에 들어 산업선진국은 자유무역의 개방체제를 꾸려가면서 지적재산권법의 중요성을 더욱 강조하며 굴뚝 없는 산업을 육성하여 교역상대국에 대하여 특허권⋅저작권 등의 보호를 강화하였다. 세계지적재산권기구(WIPO)와 세계무역기구(WTO)를 중심으로 한 지적재산권 보호 요청은 한국의 산업계에 커다란 부담이었다. 국제화⋅정보화에 관한 시대적 요구를 반영하여 정보사회에서 요구되는 디지털 기술의 발전을 꾀하는 데에 초석을 마련하였을 뿐만 아니라, 기술력 향상에 힘입어 한국 특허법은 한국을 정보사회로의 발전시키는 데에 중요한 역할을 하였다. 지난 50년간 특허법의 발전으로 한국 특허청(KIPO)이 IP5로서 국제적 역량을 높여왔지만, 이에 상응하는 기술의 질적 향상은 양적 성장에 미치지 못하였다. 정보사회의 국제경쟁력을 확보하려면 창의적 사고에 기한 기술혁신의 성과를 이끌어내는 것이 필요하다. 지난 성과를 바탕으로 질적 수준의 향상을 확보하는 노력이 뒷받침되어야 한다.
Abstract
In the two decades after 1970s, there was a great transition from industrial society to information society in Korea. In the middle of 1990s the new wave of a digital technology has made our society digital world. The Patent Act has been a main law of industrial property, and has played an important role of industrial progress in Korea. Also it has become a driving force toward information society to go beyond function of industrial information. Developed countries have strengthened the protection of the intellectual property rights(IPRs) in general, and have enlarged their own economies through enforcement of patent and copyright based on the free trading system, such as WTO/TRIPs. The response to domestic and international tasks has made Korean industries and way of life enhance one of big technology countries IP5* and the society on digital convergence and ICT infrastructures. The legislation on intellectual property rights has been affected by industrial situation and societal requirements, also the related laws themselves have driven the developmental demand of technology for the purpose of special goals. In light of the short history of Patent Act in Korea, we can acknowledge the quantitative success in all field of technologies, we have some assignments to put the innovative technology on it.
