초록
본고는 최근 발효된 한-캐나다 FTA의 원산지 규정 및 통관절차의 주요 쟁점에 대하여 검토하고 있으며, 특히 한-미 FTA 원산지 규정 및 통관절차와의 유사점 및 차이점에 대하여 분석하고 있다. 이러한 검토결과를 바탕으로, 한-캐나다 FTA 협상을 평가하고, 그 시사점을 도출하는 한편, 한-캐나다 FTA를 전략적으로 활용하기 위해 업계 및 정부에 필요한 제언을 하고자 한다. 먼저 캐나다와 교역을 하는 업계와 기업들에게 한-캐나다 FTA는 특혜관세 혜택을 받을 수 있는 좋은 기회를 제공하고 있다. 이를 위하여 업계 및 기업들은 한-캐나다 FTA 원산지 규정 및 통관절차의 내용을 정확하게 숙지하고, 원산지 규정 중 활용할 수 있는 조항을 통하여 해당 물품이 원산지 지위를 획득할 수 있도록 노력하여야 할 것이다. 특히 누적조항을 전략적으로 활용할 필요가 있다. 최근의 생산공정 및 생산구조가 소위 글로버 소싱(global sourcing)이나 가치사슬(value chain)에 의해 여러 나라에서 나누어 진행되는 상황을 고려해 볼 때, 캐나다 뿐 아니라 미국, 칠레, 페루 등과의 FTA 네트워크를 적극적으로 활용하여 기업의 이윤을 극대화 할 수 있을 것이다. 한편으로 관련 기업은 생산 재료 및 공정에 대한 관련 자료 보관의무를 철저히 하여 원산지 검증에 대한 충분히 대비를 하는 것도 필요하다. 정부는 신규로 체결된 FTA에 대한 홍보 및 설명회 등을 통하여 관련 기업에 정보를 제공하고 이를 적극적으로 활용할 수 있도록 지원하여야 한다. 또한 원산지 기준의 통일화 작업에 힘을 쏟아야 한다. 특히 동일한 지역 또는 인접 지역에서 여러 건의 FTA가 체결되는 경우, 원산지 규정 및 기준이 통일되어야 그 시너지 효과를 극대화할 수 있다. 정부와 기업의 이러한 노력과 적극적인 자세가 있어야만 한-캐나다 FTA가 진정한 양국 간 교역과 투자를 증진하고 활성화하는 경제고속도로로서 기능할 수 있게 될 것이다.
Abstract
This article intends to review and analyze Rules of Origin and Customs Procedures of Korea-Canada FTA by comparing with those of Korea-US FTA. Based upon the analysis, this article provides suggestions for traders and the government to realize maximum benefits of Korea-Canada FTA. Importers and exporters should understand the Korea-Canada FTA in order to claim preferential tariff treatment and gain the benefit. They may take advantage of accumulation provision under rules of origin of Korea-Canada FTA. Considering global sourcing and value chain in manufacturing process, they may Korea’s FTA network which is extended to the US, Canada, Chile, and Peru. On the other hand, they need to keep the relevant records during the specified time and prepare for the verification process. The government has to provide relevant information on newly concluded FTA for traders. It should make an effort to develop uniform rules of origin and customs procedures. With constant efforts of the government and companies concerned, Korea-Canada FTA can be a highway to promote trade and investment between the two countries.
