통일한국을 대비한 남북한지방자치법제의 비교와 통합적 개편방안

In the process of unification between South Korea and North Korea, comparing the degree of completion of autonomous local government system, democratic maturity of local government, self-supporting and independent ownership of residents, and residents’ participation, it is expected that the South Korean local governments would play an important leading role, in practical terms, in setting up the policy for the North Korean local administrations and executing the policy efficiently. Thus, first of all, the unification leading force needs to consider required major local policies and integrated legislation for residents from all angles and prepare for basic plan to accept them reasonably, coping with social, regional conditions and the situations of times rapidly and exactly, which could be changed chaotically and intricately. The unification leading force, furthermore, shall make the autonomous local government system well prepared to be managed and led positively and reasonably, based on the policies and legislation. For doing this, overall legislation improvement shall be preceded to perform the objectives and practical strategies efficiently, giving uniformity to the national law including constitution. Accordingly, it should be expected that the future unified Korean government will minimize confusion and strife over local government administration systems of both sides and promote legal administration by local governments as well as legal stability for the residents. The purpose of the unified local government act is to overcome the sense of national difference and severance by succeeding to and developing the philosophy of autonomous local government system, including democratic legitimacy of local government, resident-based substantial local government, and realization of balanced regional development, and to pursue the prosperity of the national community.
