미국에서 국토안보부의 출범과 위기대응법제의 변화
The Establishment of Department of Homeland Security and Its influence on National Response System in the U.S.

초록
어떤 국가가 가지고 있는 재난관리체계(emergency management system)의 구성요소, 그 역할, 기능 및 상호관계는 개별국가에 따라 다르다. 미국에서 재난․재해가 발생한 경우 이에 대한 제1차적 책임은 주정부가 담당하는 것으로 되어 있고, 연방정부는 주정부의 재난․재해에 대한 대응활동을 지원하는 것으로 이루어져 있다. 연방재난구호지원활동을 종합적으로 규정한 법률로는 스태포드 재난구제 및 긴급구제법(Stafford Disaster Relief and Emergency Assistance Act)이 제정되어 시행되어 왔다. 9.11 테러 이후 대규모 위기상황에 효율적으로 대비하고 대응하기 위하여 미국 정부는 22개의 연방정부기관을 통합하여 2003년 3월 국토안보부(Department of Homeland Security)를 창설하게 되었다. 국토안보부(DHS)는 24만 여명의 인원을 가진 거대 조직으로 연방위기관리청(FEMA)도 그 산하기관이 되었다. 카운티 등 지방정부가 공공 안전관리기관이 소재하고 있지 않은 소규모 지역 공동체 및 카운티 내 여타 지방정부들과 병합되지 않은 지역에서 재난관리에 제1차적 책임을 진다. 상위정부로서 주정부는 일반적으로 발생되는 재난의 정도가 발생지 지방정부의 대응자원 혹은 지방정부의 대응능력을 초과하는 것으로 판단될 때에 지방정부에 대하여 기술적․재정적 지원을 제공할 책임을 가지고 있다. 연방정부 수준에서의 국가 재난관리체계는 주정부와 지방정부의 재난대응 재원 및 능력이 고갈되고 부족할 때 연방정부 차원의 대응․지원이 이루어진다. 국토안보부(DHS)의 창설로 사고지휘체계(Incident Command System)가 미국 전역의 모든 위기대응을 위한 체계로 받아들여지게 되었고 재난의 대비·복구와 더불어 테러리즘 예방 및 안전보장 증진, 국정안전과 관리, 이민법의 집행과 관리, 사이버공간의 보호와 안전 등도 하나의 부처 내에서 총괄적으로 시행되는 것이 가능해졌다. 미국 국토안보부(DHS)는 국가위기관리계획(NIMS)과 국가대응계획(NRP)이 전국적으로 시행되도록 하고 있다. 이렇게 위기관리부분에서는 통합형을 추구하지 있지만 안전관리부분은 여전히 여러 연방법률들과 여러 연방위원회들에서 담당하고 있어서 분산형을 취하고 있다. 이러한 미국의 법제는 우리나라에서 현재 세월호 참사 이후 논의되고 있는 새로운 국가위기관리체제의 구축에 많은 시사점을 줄 것으로 보인다.
Abstract
Every country has its own emergency management system. In the U.S., the state government has a prime responsibility to response disaster and the federal government can assist the state government's efforts to manage the disaster when it goes beyond state government ability. Stafford Disaster Relief and Emergency Assistance Act provides this kind federal assists to victims when a major disaster happened. The Federal Emergency Management Agency, an independent Cabinet- level agency, was charged with leading the government's response to disaster. With the passage of the Homeland Security Act in November 2002, the Department of Homeland Security came into being as a Cabinet-level department to further coordinate and unify national homeland security efforts in the U.S. FEMA has become a part of the DHS. With the establishment of DHS, Incident Command System would apply nation wide. National Incidence Management System and National Response Framework would be applied to all hazard in the U.S. This comprehensive approach is applied in disaster management areas, multiple approaches are adapted to secure safety in the U.S. It would be a good reference for Korean government to establish a new emergency management system to response disaster in Korea.
