국제항공운송에 관한 통일협약인 몬트리올협약 제19조에 따르면 운송인은 승객·수하물 또는 화물의 항공운송중 지연으로 인한 손해에 대한 책임을 부담하지만, 운송인 본인이나 그의 고용인 또는 대리인이 지연손해를 피하기 위하여 합리적으로 요구되는 모든 조치를 다하였거나 또는 그러한 조치를 취할 수 없었다는것을 증명한 경우에는 책임을 지지 아니한다. 하지만, 유럽지역에서 적용되는 유럽연합 규정 Regulation(EC)No.261/2004는 몬트리올협약과 조금 다른 내용을 규정하고 있다. 천재지변과 같은 경우에 항공사가 승객에 대해 일정한 보호의무를 법률상 부담하게 되는 것이다. 사안에서 유럽소재 저가항공사인 피고가 운항하는 국제선의 항공권을 98유로에구입한 원고는 비행지역의 화산폭발로 운항편이 취소된 이후 운항이 재개될 때까지 본인이 지출한 비용 1,130유로를 피고 항공사에게 청구하는 소송을 제기하였다. 본고는 이 사안을 중심으로 유럽에서 제정되어 시행중인 항공소비자 보호 법규 Regulation(EC)No. 261/2004의 내용을 살펴보고, 사안에서 문제가 된 여러 가지 쟁점들 즉, 몬트리올협약을 비롯한 국제협약과 유럽연합 규정 간의 법규 충돌의 문제, 비정상 상황의 발생에 따른 항공운송인의 책임과 의무, 비례의 원칙 준수여부, 영공폐쇄 명령을 내린 정부에 대한 항공사의 손실보전 청구의 가능성 문제 등을 살펴보았다.
Abstract
Following the eruption of the Eyjafjallajokull volcano in Iceland on 2010, theairspace over most of northern Europe was closed on account of the riskrepresented by the volcanic ash cloud. The plaintiff was one of the passengerswhose flight from Faro to Dublin was cancelled because of the volcaniceruption. The plaintiff alleged that airline company, the defendant, did notprovide her with the necessary assistance on Regulation(EC)No 261/2004. TheRegulation depending on the circumstances of the travel disruption, requiresair carriers to: provide passengers with assistance, such as meals, refreshments,telephone calls and hotel accommodation; offer rerouting and refunds; pay aflat rate compensation of up to 600 per passenger, depending on the flightdistance; and proactively inform passengers about their rights. This article is to seek the proper direction of legislations and/or revisionsfor protection of airline consumer in Korea from the decision of the noted caseand Regulation(EC) No. 261/2004.
