긴급자동차의 골든타임 엄수를 위한 도로교통법 개정 필요성에 대한 고찰- 구급차를 중심으로 -

초록
사람의 생명은 세상의 그 무엇보다도 귀중하다. 그러므로 우리 헌법적가치에 있어서도 생명의 가치는 늘 최고의 자리에 있다. 따라서 한 생명을 구하기 위해 우리 사회의 구성원들은 최선을 다 해야만 한다. 그런데전문가들은 생명의 위기에 빠진 사람을 구하기 위해서는 5분이 제일 중요하며, 따라서 그 시간을 ‘골든타임’이라고 한다. 그러므로 긴급자동차인구급차는 어느 곳에서 생명에 대한 위기가 발생하더라도 골든타임 내에도착할 수 있어야 한다. 그러나 골든타임을 지킬 수 있는 것은 구급차만의 노력으로는 불가능하다. 그래서 우리 사회의 구성원들 뿐 아니라 사회의 시스템도 그에 맞게 설계되어 있어야만 한다. 그 가운데 중요한 것이긴급상황에 따른 도로교통 시스템이라고 할 수 있는데, 아쉽게도 우리 도로교통 시스템이 골든타임 지켜주기 어렵다는 것은 다양한 사회경험을통해 나타나고 있다. 단적으로 말해, 우리 도로교통 시스템의 가장 큰 문제점은 긴급상황에따른 불확실성을 해소해 주지 못한다는데 있다. 즉, 긴급상황 발생 시 구급차가 이동하는 경로의 주변 운전자들 뿐 아니라 통행인들이 긴급상황을 인식하고, 구급차가 빨리 긴급현장에 도착할 수 있도록 협조해 주어야하며, 구급차 운전자는 최선을 다해 가장 빨리 도착할 수 있도록 운행을하여야 한다. 그러나 우리 규범시스템은 사실상 그와 같은 메커니즘을 충분히 담고 있지 못한 실정이다. 이는 우리나라의 교통문화가 여전히 성숙해가는 과정이 있기 때문이라고 생각 할 수도 있지만, 그보다는 긴급상황의 경우 구급차와 구급차가 이동하는 경로의 주변 운전자들 및 통행인들이 그 상황을 제대로 인식하고 적절한 조치를 취할 수 있도록 규범체계가 충분히 마련되어 있지 않기 때문이라고 생각한다. 무엇보다 긴급상황에서 자신의 행동에 대한 책임분배가 어떻게 될지 모르는 상황에서 당사자들은 주저하게 되고, 결국 골든타임을 지킬수 없게 될 경우 그 피해는고스란히 생명의 위기를 맞은 사람에게 돌아가는 것이다. 그런데 그처럼 골든타임을 지킬 수 없는 이유를 정부는 구급차가 이동하는 경로의 운전자들이 제대로 협조해 주지 않아서 소위 ‘모세의 기적’이 일어나지 않기 때문이라고 판단하고, 협조하지 않는 운전자들에게 책임을 지우는 정책을 마련함과 동시에 가상의 상황을 만들어 한두 번 ‘모세의 기적’을 체험하는 것에 그치고 있다. 그러나 해당 문제를 해결하기위해서는 우리 규범체계가 골든타임을 지킬 수 있도록 정비되어야 하는데, 우선 면허를 위한 교육과정에서 긴급상황에 대한 내용이 충분히 교육되어야 한다. 그리고 도로교통법은 구급차 운전자가 가장 빨리 위기 현장에 도착할 수 있도록 관련 내용들이 정비되어야 하며, 특히 긴급상황 시구급차 운전자, 구급차 이동경로의 운전자 및 통행자의 책임관계를 명확히 규정해야 할 것이다. 그를 위해 현행 도로교통법상에 규정되어 있는내용들을 개정할 필요가 있다. 그리고 법원은 구급차 운전자가 “생명을구하기 위해 가능한 한 가장 빨리 현장에 도착해야 한다”는 규범명령이형성될 수 있도록 판례를 형성할 필요가 있다. 아무리 법률이 긴급상황에서 구급차가 가장 빨리 도착할 수 있도록 규정한다고 하더라도 법원이그를 소극적으로 적용하게 되면 구급차 운전자는 소극적인 구급차 운행을 할 수 밖에 없기 때문이다. 하지만 현재 가장 중요한 것은 불확실성을해소해 주지 못함으로 인해 긴급상황에서 피해자의 생명에 문제가 발생하지 않도록 현행 도로교통법을 하루빨리 개정하는 것이다. 그래서 적어도 지금 이 시간에도 골든타임이 지켜지지 못해서 죽어가고 있는 생명들에게 최선을 다하여 우리 헌법이 표명하고 있는 생명존중의 가치를 실현하여야 할 것이다.
Abstract
Life is more important than anything else. And the Constitutionplaces the highest value on human life. We as members of our societyshould do our best to save a life who is in danger. Experts say that itis important for emergency responders to be able to save a life withinthe first five minutes of an incident which is known as golden time. Therefore, it is expected that emergency vehicles should be able toarrive at the scene of an incident within golden time. To do so, our traffic control system should be designed properly tohelp emergency vehicles reach the scene quickly and safely to performtheir life-saving work. Unfortunately, we have seen many cases wherethe current traffic control system failed to enable emergency responseaction to be properly undertaken. The biggest problem with our traffic control system is that it hasnot been able to resolve many problems arising from uncertainties inan emergency situation. The traffic control system should be designedto be able to help both drivers and passersby recognize an emergencysituation and to require them to yield to emergency vehicles, so thatthey can arrive quickly where they are needed. And the driver of anemergency vehicle is obligated to drive as safely and quickly aspossible. However, our traffic control system does not have effectivecontrol measures for emergency situations. There is still a lack of aproper system in our society that allows people to recognize an emergency situation and to take action in an appropriate manner. As aresult, people do not have a clear idea of what to do and whatresponsibilities they have in these emergency situations, so preciouslives are being lost due to our failures to take proper emergencyaction within golden time. However, the government determines that uncooperative drivers whorefuse to give way to emergency vehicles are mainly responsible forcausing a failure to save a life within golden time. As part of itsefforts to resolve this, the government came up with a policy thatholds those uncooperative drivers legally responsible for their failure toyield to emergency vehicles and provided drivers with opportunities tolearn how cars on the road are making way and moving out of thepath of emergency vehicles through a few virtual training events. Butthat’s not enough. In order to fix this fundamentally, we need tocreate a proper system that allows people in imminent danger to berescued within golden time. We also need to strengthen education andtraining on emergency situations for those seeking to obtain driver’slicense. And the road traffic control law should be revised in a waythat allows emergency vehicles to arrive where they are needed asquickly as possible. It also should be able to define legalresponsibilities of drivers of emergency vehicles, drivers into the pathof emergency vehicles and nearby passersby in a clear manner. The court should make a precedent-setting ruling that requires thedriver of an emergency vehicle to arrive as quickly as possible tosave a precious life. However, even with the law in place that requiresemergency vehicles to arrive quickly, it could become useless if thecourt applies the law in a passive manner. That will result in driversoperating their emergency vehicles passively on the road in emergencysituations. In conclusion, what is most important is that we need tourgently revise the road traffic control law in a way that removes the existing uncertainties, so that many precious lives can be saved. That way, it will allow us to realize the value of human life which is themost important constitutional value.
