중개수수료에 대한 시장참여자의 만족도 분석 - 서울특별시 강서구와 양천구를 중심으로 -

초록
본 연구는 부동산중개시장에서 시장참여자의 중개수수료 만족도를 검토하고, 중개수수료를 둘러싼 중개업자와 중개의뢰자 간의 분쟁을 해소하는 방안을 도출하여, 공정하고 건전한 부동산 거래질서를 개선할 수 있는 방안을 제시하는 것을 연구의 목적으로 하였다. 이를 위하여 분쟁의 원인을 점검하고 중개수수료에 대한 시장참여자의 만족도를 분석하였다. 분쟁의 주요 원인은 거래가액에 따라 서로 다른 최고 한도의 수수료율 또는 금액을 정하여 그 이하 범위 내에서 중개업자와 중개의뢰자가 합의하여 중개수수료를 정하도록 하고 있는 것임을 확인하였다. 중개업자는 최고 요율을 적용하려고 하고 중개의뢰자는 최저 요율을 적용하려고 하며, 중개수수료 지급을 둘러싸고 발생하는 갈등을 완화하거나 조정할 수 있는 별다른 대책도 없다는 것이다. 이를 확인하기 위하여 중개업자와 중개의뢰자의 중개수수료에 대한 만족도를 비교⋅분석하고 인식의 차이를 점검하였다. 분석결과, 그들은 중개수수료율이 다단계 역진요율체계로 되어 있어서 이해하기가 어렵고 계산하기가 복잡하다고 인식하였다. 또한 정해진 상한요율 또는 최고 한도액 범위 내에서 중개업자와 중개의뢰자 간에 협의를 하여 중개수수료를 정하도록 하고 있어서, 당사자 간에 분쟁을 야기할 가능성이 높기 때문이라고 인식하고 있다. 이를 개선하기 위해서는 요율 체계를 단순화하고 단계별 확정요율이 필요함을 확인하였다.
Abstract
In the real estate brokerage market, commission is one of the major elements of the dispute between broker and sponsor of real estate brokerage. Within the brokerage fees structure that is defined by the law, brokerage commission established by the broker and sponsor should be agreed. This ambiguous standard has become the cause of conflict between the real estate agent and sponsor, also, mitigation measures for the conflicts that surround the commission are not in tune. As a result of analysis, both of brokers and sponsor are not satisfied with the current system, respectively. Brokers and sponsor are not satisfied with the current brokerage commissions system, respectively. Therefore, how to determine the commissions and simplify the system, such as the introduction of a comprehensive service system through the mediation of the dispute by improving service levels to help reduce the causes of system improvements are necessary.
