언론보도에 따른 피해자의 2차 피해 방지를 위한 제도와 그 개선방안

When a crime occurs, the media reports the informations about the criminal victims under the purpose of the public interest defence, but this violates the privacy of the surrounding people including victims and their families. Moreover, these days, as the role and the importance of media sources based on internet are growing bigger rapidly, the aspect of human rights violation of the victims due to the erroneous media reports is getting more complicated and diverse. And secondary damages of the victims due to those are spreading quickly, widely and consistently. However, the media reports on the victims make secondary damages worse, for example causing a violation of the personal rights and privacy such as the portrait rights of victims. Also, it makes hard for victims to recover from the damages which are already done to them. Therefore, the establishment and practice of the effective system which can prevent secondary damages of the victims, particularly women and children victims, due to the media reports, should be done previously. To prevent the victims’ secondary damages by media reports, above all, the regulation and guideline regarding of media reports should be suggested in a more clarified way by the types of crimes. And in the training for the media workers, victims’ remedies and medical institutions, investigative agencies and judge a victims-related education should be intensified. But also the forceful effort of the government is needed to make and distribute the reaction manuals for the media reports. And by preparing strict report criterions for themselves, mass media organizations should suppress the reports about victims. Furthermore, by establishing a policy which intensify the responsibility of them as a public institution, media organizations should be the one who actively protect and guarantee the rights of victims.
