프로야구선수와 프로야구선수협회의 법적 지위

초록
프로야구 출범 34년을 맞는 현재, 한국 프로야구는 질적으로나 양적으로 많은 성장을 하였다. 경제적으로 어려웠던 시기에는 전국민의 위안이 되었고 스포츠인들에게는 선망의 대상이 되었다. 그러나 그 이면에는 열악한 계약조건이나 부당한 대우 속에서 고민하고, 구장을 밟아 보지도 못하고 사라져 간 선수들도 적지 않다. 프로의 세계는 선수의 실력에 따라 정당한 보수를 받을 수 있도록 하여 선수들 스스로 자신의 경기력을 더욱 증강시키게 하는 메카니즘이 있다. 그러나 이 메카니즘이 선수들과 계약을 맺는 상대방의 경제적 우위에 의하여 허물어지게 된다면 구단이나 선수는 물론이거니와 관객들도 불행해 질 수밖에 없다. 수준이 낮은 프로경기를 누가 관람하겠는가. 본고는 「야구계의 프로선수가 집단적 노동법에 기한 보호를 받을 수 있을지」의 여부에 대한 관점에서 검토를 한다. 그리고 그 전제로서 그 프로선수의 법적 지위나 권리의무관계를 결정하는 「선수계약」을 둘러싼 법률관계 등을 우선 확인한다. 그래서 우선 이에 관한 국내 상황을 살펴보고, 이어서 일본 프로야구선수의 근로자성 인정과 프로야구선수회의 단체성 인정 과정, 그리고 단체성이 인정되는 경우의 의무적 단체교섭사항을 살펴봄으로써 향후 우리나라의 프로야구선수협회가 정립해야 할 근로자단체로서의 지위를 가늠해 보고자 한다.
Abstract
It's been almost 34 years since the professional baseball started. And among many ofprofessional sport leagues in Korea, baseball is the most popular one but cannot strenuouslyinsist that the league has to immaculate procedures between baseball clubs and the players. But times have changed, and some players started to assert their rights to be equal totheir employed clubs. The establishment of KPBPA (Korea Professional Baseball PlayersAssociation) in 2000 was the first step for the players. However, the KPBPA is still illegitimate institution by the league and the clubs. Playersare not recognized as an ‘employee’ by the court. As a result, the KPBPA is not an tradeunion and all players cannot conclude collective agreement. So they have no power to standagainst an unfair labor practice. In this article, the author focused on the course of the establishment of the JPBPA(JapanProfessional Baseball Players Association). In Japan, the JPBPA has been recognized as a tradeunion which can conclude collective agreement like the Major League in United Station. Andthey can negotiate their salary with the owner of a baseball club on even ground. That isfull of suggestions.
