복수의 채무자 사이 채무중첩관계에 관한 주문표시 방법 - ‘각자’에 대한 대안 모색

수인의 채무자가 부담하는 채무 중에는 그 경제적 목적이 완전히 동일하거나 일부 겹치는 부분이 있는 탓에 어느 한 사람의 채무가 변제 등으로 소멸하면 그에 따라 다른 사람의 채무도 전부 또는 일정 범위에서 절대적으로 소멸하는 중첩적인 관계가 인정되는 경우와 그렇지 않은 경우가 있다. 연대채무자들, 합동채무자들, 불가분채무자들, 부진정연대채무자들, 주채무자와 보증인 등이 부담하는 채무 사이에는 위와 같은 중첩관계가 인정되는 반면, 분할채무자들이나 그 밖에 단순히 동종의 채무를 부담하는 채무자들 사이에서는 그러한 의무중첩관계는 인정되지 않는다. 현재 우리 법원의 실무에서는 공동피고들에 대하여 가령 금전지급을 명하는 이행판결을 선고함에 있어 그 이행의무 사이에 아무런 중첩관계가 없는 경우에는 “각”이라는 말을 사용하여 “피고들은 원고에게 ‘각’ ○○원을 지급하라.”라는 주문을 쓰고 있다. 반면 공동피고들의 이행의무 사이에 중첩관계가 인정되는 경우에는 그 의무중첩관계 전반을 아우르는 기본적인 표현으로 “각자”라는 말을 사용하여 “피고들은 ‘각자’ 원고에게 ○○원을 지급하라.”라는 주문을 쓰고 있다. 즉 판결주문에서 “각 지급”과 “각자 지급”은 전혀 다른 의미로 사용된다. 공동피고들 사이에 의무중첩관계가 인정되는 경우와 그렇지 않은 경우를 판결주문만으로도 간단히 구별할 수 있게끔 하는 현재의 실무태도는 타당한 것으로 보인다. 다만 피고들의 이행의무 사이에 중첩관계가 있음을 표시하는 “각자”라는 말은 그렇지 않은 경우를 표시하는 “각”이라는 말과 일반의 언어관용 면에서 별다른 의미 차이가 없다는 문제가 있다. 판결의 당사자를 비롯한 일반인들은 통상적으로 “각자”와 “각”을 동의어 내지 유의어로 받아들이고 있음에도 불구하고, 법조 내부에서만은 이를 전혀 다른 의미로 사용하는 이와 같은 괴리현상은 ‘판결의 분쟁해결 기능’을 저해할 뿐만 아니라 ‘國民을 위한 司法’이라는 견지에서도 바람직하지 않다고 할 것이다. “각자”라는 말은 일반적으로 “한 사람 한 사람마다”, “(제)각각”, “따로따로” 등의 의미로 사용된다. 그러므로 “각자”라는 말은 피고들이 부담하는 이행의무 사이에 어떠한 중첩관계가 있다는 점을 표시하기에는 기본적으로 부적절한 용어이다. “각자”를 대체할 수 있는 다른 용어를 모색할 필요성이 절실하다. 공동피고들 사이의 의무중첩관계를 표시하는 판결 주문상의 기본적인 용어로는 “각자” 대신에 “공동하여”라는 말을 사용하는 방안이 적절하고도 무난해 보인다. 그리고 “각자”를 대체하는 기본적인 표현으로 “공동하여”를 사용한다고 하더라도, 피고들이 부담하는 의무가 연대채무나 합동채무인 것이 심리과정에서 분명히 확인된다면 그와 같은 경우에 있어서는 종전처럼 “연대하여”나 “합동하여”라는 표현을 그대로 사용해도 무방하다고 판단된다.
Abstract
Methods for Indicating the Overlapping Duty Relationship between Multiple Obligorsin Court Dispositions- The Search for an Alternative Expression to “Individually” Kim, Mi-lee Regarding liabilities burdened by multiple obligors, there are cases where the overlapping relationship between certain liabilities are acknowledged because their financial purposes are completely identical or partially overlap with each other, and cases where such an overlapping relationship is not acknowledged. In the case of the former, when one individual's liability is extinguished due to repayment and etc., another individual's liability may also be absolutely extinguished completely or partially. The aforementioned overlapping relationship is acknowledged between the liabilities owed by joint and several obligors, joint and several obligors as prescribed by the Bills of Exchange and Promissory Notes Act, the principal obligor and the guarantor and etc. However, the aforementioned relationship with overlapping duties (hereinafter “overlapping duty relationship”) is not acknowledged between separate obligors or other obligors who merely owe the same type of obligation. Presently, our court's practice when sentencing judgments of performance to joint defendants is to use the term “each(각)” when no overlapping relationship exists between the duty performances; for example 「defendants “each” pay ○○ won to the plaintiff」. In contrast, when an overlapping relationship does exist between the joint defendants, the basic expression used is “individually(각자),” so the disposition is written as 「defendants “individually” pay ○○ won to the plaintiff」. To summarize, “each payment(각 지급)” and “individual payment(각자 지급)” are used as entirely different meanings in court dispositions. The current attitude of legal practice appears adequate for utilizing the disposition to enable easy differentiation between cases where an overlapping duty relationship is acknowledged and cases where it isn't. The only problem is that in common usage, the word “individually” - which expresses the existence of an overlapping relationship between the defendants' duty performance - is not so different in meaning from “each,” which is used to indicate non-existence of the aforementioned relationship. Considering that the general public including the parties at the trial usually understand “each(각)” and “individually(각자)” as synonymous or identical words, it is inappropriate for the legal profession to alienate itself by using them as words with completely different meanings. This type of alienation could be detrimental to the dispute resolution capabilities of court decisions and is also undesirable in the light of judicial services for the people. The word “individually” commonly refers to meanings such as “one by one,” “each and every,” or “separately.” Therefore, “individually” is basically an inappropriate term for expressing any overlapping relationship concerning the defendants' performance of duty. It is direly necessary to find a term which can replace “individually.” Instead of “individually,” “conjointly” appears to be an appropriate and safe basic terminology for indicating an overlapping duty relationship between joint and several defendants within the context of court dispositions. And even when the expression “conjointly” is used as a replacement of “individually,” the previous practice of using expressions such as “jointly” can still be maintained for cases where it is clearly confirmed during the trial that the defendants' liabilities were joint liabilities or joint liabilities as prescribed by the Bills of Exchange and Promissory Notes Act.
