Unconstitutionality of the Outlawed Trade Union Notification

초록

「노동조합 및 노동관계조정법 시행령」 제9조 제2항은 “노동조합이 설립신고증을 교부받은 후 법 제12조 제3항 제1호에 해당하는 설립신고서의 반려사유가 발생한 경우에는 행정관청은 30일의 기간을 정하여 시정을 요구하고 그 기간 내에 이를 이행하지 아니하는 경우에는 당해 노동조합에 대하여 이 법에 의한 노동조합으로 보지 아니함을 통보하여야 한다.”고 규정하고 있고, 「교원의 노동조합 설립 및 운영 등에 관한 법률 시행령」 제9조 제1항은 위 규정을 준용하고 있다. 고용노동부 장관은 이들 규정에 따라 2013. 10. 24. 해직교원의 조합원 자격을 인정하고 있고 또한 해직교원 9명이 가입되어 있다는 이유로 전국교직원노동조합에게 ‘이 법에 의한 노동조합으로 보지 아니함’을 통보하였다. 전국교직원노동조합에 대한 고용노동부 장관의 법외노조 통보의 적법성을 따지기에 앞서 먼저 ‘과연 우리나라의 헌법질서 아래서 법외노조 통보제도가 과연 타당한 것인가’라는 의문을 가져볼 필요가 있다. 본고는 법외노조 통보제도를 규정하고 있는 「노동조합 및 노동관계조정법 시행령」 제9조 제2항이 우리나라의 헌법질서 아래서 정당화될 수 있는가의 문제를 형식과 내용의 두 가지 측면에서 검토함을 목적으로 하는바, 형식의 측면에 관해서는 의회유보나 법률유보의 원칙이, 내용의 측면에 관해서는 과잉입법금지의 원칙이 문제될 것이다.

Abstract

This article is about the outlawed trade union notification of the Ministry of Employment and Labor(hereinafter “Labor Ministry”) to the Korean Teachers and Education Worker`s Union(hereinafter “KTU”). On 24. November 2013, the Labor Ministry notified that KTU would no longer be recognized as a legal trade union, because it had not amended its constitution to ban dismissed and retired teachers from membership, which was according to the Article 9 (1) of the Enforcement Decree of the Act on the Establishment, Operation, Etc., of Trade Unions for Teachers(hereinafter “the Enforcement Decree of Act of Teachers` Union”) and he Article 9 (2) of the Enforcement Decree of the Labor Union and Labor Relations Adjustment Act(hereinafter “the Enforcement Decree of Labor Union Act”). The Article 9 (1) of the Enforcement Decree of Act of Teachers` Union enacts as follows: “Except as prescribed in paragraph (2), matters not provided for in this Decree with regard to trade unions and labor relations adjustments applicable to trade unions for teachers shall be governed by the Enforcement Decree of the Trade Union and Labor Relations Adjustment Act.” and the Article 9 (2) of the Enforcement Decree of Labor Union Act enacts as follows: “Where, after a trade union is delivered with a certificate of report of establishment, there arise reasons for returning the written report of establishment, which fall under Article 12 (3) 1 of the Act, the Administrative Authorities shall demand correction within the specified period of thirty days, and if the correction is not performed within this period, they shall notify the trade union in question that it shall not be regarded as a trade union as provided for under this Act.”The KTU claimed that the outlawed trade union notification of the Labor Ministry violated the constitutional right to organize a group and filed a lawsuit. However, the Seoul Administrative Court ruled that the KTU cannot maintain its legal status as a legitimate trade union because it allows membership of fired teachers. In a ruling statement, the court said the decision by the Labor Ministry is not against the Constitution. The KTU appealed. The Seoul High Court accepted a request from the KTU to halt a lower-court ruling that stripped the union of its legal status until an appellate court verdict is handed down and asked the Constitutional Court to review the constitutionality of Article 2 of the Act of Teachers` Union, which bans the KTU from letting in fired teachers as its members. It is necessary to examine the validity of the Article 9 (2) of the Enforcement Decree of Labor Union Act. Article 9 (2) of the Enforcement Decree of Labor Union Act prescribing the notification has no lawful ground of delegation in the Labor Union Act, which violates the principles of the Constitution such as the principle of legislation by the Congress, the principle of delegated legislation. So the outlawed trade union notification of the Labor Ministry can not be justified. Furthermore, such notification of the Labor Ministry also violates the principle of prohibiting the excess because there are more less alternatives than denying the reality of the KTU by notifying that it shall be outlawed trade union. So the outlawed trade union notification to the KTU is illegal and should be null and void.
