종교와 저작권에 관한 논의 - 교회를 중심으로 -

A religion stands out an important mission to spread the gospel through missionary works. The religious organizations create various copyrighted work sand use them for missionary works, worship, hymns, The Bible, etc. In general, the use of religious works has came across as the issue of extraterritoriality in Korea. As there has recently improved awareness of the importance of protecting intellectual property, however, the copyright disputes relating to religious work shave been increased. There is also few domestic study and internal rules ofreligious organizations on the religious use of copyrighted works. This article examines domestic and abroad copyright issues focusing on church including derivative works of the translated Bible, works made for hirefor sermons, moral right for hymns and ownership for religious books. Given the purpose of religious works and characteristics of the use of the works by religious groups, it also emphasizes that they should be differently treated from general works. This article also reviews the limitation of copyrights in religiousus of works in United States and Germany, and suggests the need of a policyand a rule for allowing a free use of religious works by religious organization sunder certain conditions.
