의사의 연찬의무의 법제에 관한 검토- ‘뉴질랜드 보건종사자의 역량 보증법’의 내용을 중심으로 -

초록
연찬의무란 의료인이 임상의학 실천 당시의 의료기술을 익혀 환자에게 적용하여야 한다는 것으로, 우리나라 현행법상으로는 의료인 단체들이 자율적으로 그 내용과 절차를 정하는 ‘보수교육’ 제도를 통하여 ‘현대 임상의학의 실천수준’을 연마하도록 하고 있다. 최근 뉴질랜드는 의료행위를 수행하는 보건종사자에 대하여 보건종사자가 취득한 각 면허의 범위에 따른 의료행위를 지속적으로 수행하기 위하여 필요한 능력과 요건을 갖출 것에 관하여 국가가 이를 강제적으로 관리하고, 만약 보건종사자가 그에 부합하지 못할 경우 제재를 가함으로써 국민의 건강과 안전을 보호한다는 취지의 ‘뉴질랜드 보건종사자 역량 보증법’을 제정하였다. 동법에 의할 때 뉴질랜드에서는 ‘능력 요구 기준 이하의 보건종사자’에 대한 감시 절차를 통하여 의료인이 최선의 진료를 제공하도록 강제하고 있는데, 이는 보건종사자 내부에서 자율적으로 규제하는 윤리적 의무를 뛰어넘어 법적 의무로 제도화하였다는 것이 특징적이다. 보수교육의 실효성을 확보하기 위해서는 의료계 내부의 자율 규제와 법적 제재의 적절한 균형 속에서 관리되어야 할 필요가 있다. 따라서 의료계 내부의 자율 규제를 활성화하기 위해 보수교육의 시간이나 최소한의 이수 내용에 대해 제재를 강화하는 것은 의미가 있을 것으로 보인다.
Abstract
Learning duty of medical persons means that medical persons should continuously improve their practice and provide the best care to the patients. According to the medical service act, medical persons should learn the latest medical practices through continuing medical education of which the program and the process are decided by the association of medical persons. Recently, New Zealand enacted the health practitioners competence assurance act to protect the safety and health of the public. The act provides the legal mechanism that enables the national authority to impose legal sanctions on health practitioners who practise below the required standard of competence to ensure that health practitioners are competent and fit to practice within the scope of practice. It also provides the mechanism that allows health practitioners to notify the authority of unqualified health practitioners for assurance of the best practice to the public. This surveillance mechanism by health practitioners legalized maintenance of competence and the best practice of health practitioners through lifelong learning as legal duty which has been considered as ethical duty self-regulated by health practitioners. Reasonable balance between self-regulation by health practitioners and legal sanction is significant for improvement of the effectiveness of continuing medical education. Thus, strengthening regulations on required hours and program of continuing medical education seems to be necessary to enhance self-regulation by health practitioners.
