고령화 사회의 대비책: 후견계약

Korea has experienced an accelerated increase in life expectancy, and in 2014, it was estimated to be 81.94 (78.51 for males and 85.06 for females). However, the quality of the elder people is not high, because one of eleven of the elder over 65 years old are suffering from dementia. Face to the aging society and the problem associated, what I can propose as a lawyer? First of all, the best way to equip the elder for the future when they lose their capability is to write down the durable power of attorney. Uniform Power of Attorney Act 2006(UPOAA) stipulates the durable power of attorney for the financial affairs. Almost states made state law for the durable power of attorney according to UPOAA and these state laws provide the statutory forms for it. Examining the content of UPOAA and these statutory forms gives a thought- provoking to us. This article aims to analyse provisions of UPOAA for the durable power of attorney, to criticise our present provisions, and propose a reasonable solutions.
