환자와 의사간 원격의료제도 도입에 대한 비판적 고찰 - 노인복지법을 중심으로 -

초록
원격의료 중에서도 환자와 의료인간의 원격의료의 도입에 대해서 찬반양론이 팽팽하게 맞서고 있는 가운데 양측에서 공통적으로 그 유효성을 인정하고 있는 부분이 오ㆍ벽지에 있는 자의 의료권을 보장하기 위한 경우와 노령으로 인하여 만성질환을 앓고 있는 자들이 반복처방을 하게 되는 경우에는 원격의료의 실효성을 인정하고 있다. 하지만 진료를 받는 다는 것은 처방을 받아 약국에 내방하여 의약품을 받는 과정까지도 연계되어 있기 때문에 이들 문제를 포괄적으로 하여 원점에서 다시 한 번 고려되어야 할 필요성이 있다. 또한 원격의료의 도입에 대해서 노인의 복지와 관련한 시대적 변화를 반영하여 논의할 필요가 있다. 과거 절대적 생존권 보장이 목적이었던 시대는 이미 지났고 현재는 국민의 개개인에게 적합한 높은 수준의 보편적 복지를 추구하고 있는 시점에서 원격진료를 단순한 생존의 문제에서 뿐만 아니라 변화된 시대를 반영하는 보건복지의 측면에서도 검토가 되어야 한다. 즉 인간다운 생활을 할 권리를 충분히 보장받을 수 있도록 하는 측면에서 원격의료의 도입에 대해서 논의가 이루어져야 할 것이다. 원격의료는 이미 시대적 조류를 거스를 수 없을 정도로 세계적 움직임이 빠르게 진행되고 있고 우리나라에서도 원격의료를 활성화하기 위한 기술측면이 어느 정도의 수준에 이르렀으므로, 원격의료를 도입은 이제 더 이상 막을 수는 없다. 다만 그 근거가 오ㆍ벽지의 환자나 고령의 노인들을 위한 것이라는 점은 노인의 특성이나 노인복지의 이념 그리고 관련된 법적 문제들로 인하여 그 주된 근거로 제시하기에 적합하지 않으므로 원격의료를 도입하여 시행하게 되었을 때 실질적으로 이 제도를 많이 활용하게 될 것으로 예상되는 청ㆍ장년층을 중심으로 원격의료제도의 시행으로 인한 문제점을 찾아내고 그 해결방안을 논의하여야 할 것이다.
Abstract
While the opinion on the introduction of telemedicine between the patient and the health care provider among the telemedicine systems is equally divided into pro and con, both parties recognize the effectiveness of the telemedicine in case of ensuring the right to receive medical attention of those who live in the distant and the remote places and in the cases that the patients having chronic diseases by the old-age get repeating prescriptions. However, since not only discussing if it is the system really needed for them is the problem in the aspect of the elderly's welfare and but also receiving the medical treatment is linked to the process of receiving prescription and the medicine, these problems need to be reconsidered comprehensively at the starting point. Since the telemedicine already has spread all over the world enough not to be able to go against the current of time and the technology of our country has reached to a certain level to vitalize the telemedinice, the introduction of the telemedicine cannot be blocked any more. However, since its basis that it is for the patients and the elderlies at distant and remote places is not appropriate to be proposed as its basis, the problems should be sought around the young and middle-aged generations who will use this system a lot when the telemedicine system is introduced and implemented and the measures to solve them should be discussed.
