지방자치단체 인권위원회 제도에 관한 고찰 - 서울특별시 인권위원회를 중심으로 -

초록
최근 한국에서는 지방자치단체 차원에서 인권도시와 인권행정에 대한관심이 커졌고, 실제로 여러 지자체에서 인권기본조례를 제정하고 담당부서를 설치하는 등의 성과가 있었다. 인권기본조례는 인권전문가와 시민들로부터 인권에 대한 의견이나 자문을 구하기 위해 인권위원회를 설치하도록 규정하고 있으며, 실제로 이 인권위원회는 지방자치단체가 인권행정을추진하는데 있어서 중추적인 역할을 담당하고 있다. 하지만 이 위원회의역할과 위상에 대해서는 충분한 논의가 진척되지 못했고 이것이 인권에관한 자치행정이 활성화되지 못한 하나의 이유가 되고 있다. 그래서 이논문에서는 정부위원회 또는 다른 지자체 위원회들과의 비교연구를 통해지자체에 설립되어 있는 인권위의 위상과 역할을 고찰해 보았다. 본 논문의 분석에 따르면 지자체인권위는 인권 관련 사안에 대한 심의․자문기능을 수행하는 자문위원회의 성격을 기본적으로 가지고 있지만, 권고 등의 특별한 권한과 독자적인 활동, 인권이라는 특수성 등으로볼 때 독립 행정위원회의 성격도 일부 가지고 있다. 이러한 이중적인 성격을 잘 이해하는 것이 지자체 인권위가 성공적으로 자리잡는데 아주중요하며, 특히 이러한 위상에 적합하도록 위원회 구성과 활동, 그리고사무지원체계를 정비하는 것이 지자체 인권위를 통한 인권자치행정의정착에 결정적으로 중요하다는 것이 이 논문의 결론이다. 마지막으로 이러한 논의를 바탕으로 이 논문은 서울특별시 인권위원회의사례를 검토하고 있다. 서울특별시 인권위원회는 사무지원기구가 부재하는등 구조적인 한계에도 불구하고 활발한 활동을 통해 서울시 인권행정이 자리를 잡는데 큰 기여를 했다. 하지만 사무지원 강화, 인권보호기능과의 연계/통합, 인권정책협의체 설치, 인권위원 선임절차 개선, 지자체인권위 간의교류협력 등의 과제가 해결되어야 그 성과가 지속될 수 있을 것이다.
Abstract
The past decade saw the proliferation of human rights ordinances in local authorities in Korea so that many local authorities have shown growing interest in human-rights-based administration. In particular, the ordinance orders local authorities to constitute a human rights commission which play a role in advising the local government. However, we do not have an enough consensus in the status and role of this human rights commission. This is why this article is dedicated to elaborating on the status and function of human rights commission in local authorities in comparison with other national and local commissions and to provide an reformation subject of human rights commissions. This article focuses on the fact that local human rights commission have the dual aspects of advisory commissions and independent commissions and suggests that local human rights commissions should be given special status and supporting system in harmony with these dual aspects. As case studies, this article deals with the case of the Seoul Human Rights Commission. Despite some systemic limitations, the Commission has produced important achievement in local human rights in Seoul. However, some follow-up measures such as strengthening administrative assistances to the Commission should be taken to further improve the function of the Commission.
