협의이혼 전 의무상담 제도의 효과

초록
본 연구는 부산가정법원에서 시범실시중인 협의이혼 전 의무상담 제도의 효과를 분석하기 위한 목 적으로 시도되었다. 의무상담에 참여한 부부 중 본 연구를 위해 면접에 동의한 11쌍의 부부와 상담 위원으로 위촉된 상담사 3명 등을 대상으로 1년간 심층면접 방식으로 자료를 수집하였다. 자료 분 석은 근거이론에 따라 개방코딩, 축 코딩, 선택코딩 등의 과정을 거쳐 협의이혼 전 미성년자 자녀를 둔 부부와 상담위원들을 통해 의무상담제도의 효과를 찾고자 하였다. 본 연구에서 상담의 효과는 전문성을 갖춘 상담사의 역량에 따라 이혼 의사결정에 차이를 보인 것으로 분석되었다. 특히, 여성 에 비하여 남성들이 상담에 대한 인식의 변화가 생겼다는 반응이 높게 나타났다. 이혼을 결심하는 심각한 상황에서도 무방비상태로 이혼으로 상황을 종료하는 대부분의 이혼 대상자들에게 의무상담 의 기회는 참여자들이 공동으로 겪고 있는 상담에 대한 선입견을 해소하고 상담프로그램에의 참여 를 유도하는 것으로 분석되었다. 분석 결과를 바탕으로 연구의 시사점과 제한점 등이 논의되었다.
Abstract
This study tried to analyze the effect of compulsory counseling system before divorcing by consent that is currently performing in Busan Family court. The Participants are consisted of 11 couples and 3 counselors who are consented to be interviewed for this study. The survey took one year and collected data by depth interview method. Data analysis followed open coding, axis coding, and selective coding procedures which based on ground theory. The effect of compulsory counseling system is tried to found out through the couples who have minors and counselors. According to the analysis, counseling effects are differed by counselors' professional competency. Especially, males' perception showed significant changes on counseling rather than females. The results showed that the compulsory counseling opportunity to most divorcing applicants relieved prejudices on counseling and led them to participate into counseling programs. Based on these results, discussions on the implications and limitations of this study are suggested.
