건강·안전 분야 규제개혁 방안에 관한 탐색적 연구

초록
세월호 사건 이후, 현정부 규제개혁의 실제적인 측면에서, 건강 및 안전 분야 규제개혁의 혼란이 가중되고 있지만, 기존 연구들은 안전 규제에 대한 보다 체계적이고 종합적인 규제개혁의 방향이나 방안을 제시해 주지는 못하고 있다. 이에 본 연구는 이러한 실제적인 문제의식을 바탕으로 하여 건강·안전 분야 규제개혁 방안에 관한 탐색적 연구를 수행하였다. 건강·안전 규제 개혁 방안을 좀 더 체계적으로 살펴보기 위하여, 규제개혁의 대상이 절차적인가 본질적인가 규제개혁의 영역이 반응적 개혁 분야인가 사전적 개혁 분야인가에 따라 4가지 영역으로 구분하여 규제개혁 방안을 살펴보았다. 본질적 측면의 반응적 개혁 영역(I)에서는 건강 및 안전규제의 차등관리 방안을 제시하였다. 차등관리의 방법과 탐색적 분석, 차등관리의 기준을 제시하였다. 절차적 측면의 반응적 개혁 영역(II)에서는 재검토형 일몰제, 사후 규제영향평가 방안, 차등관리 절차를 제시하였다. 본질적 측면의 사전적 개혁 영역(III)에서는 위험분석, 대안적 규제 선택 방안을, 절차적 측면의 사전적 개혁 영역(IV)에서는 규제심사절차의 재설계 방안, 비재정지원위임 검토 방안을 제시하였다.
Abstract
The government has taken ‘two-track’ approach about regulatory reforms in the safety sector since the Sewol ferry disaster, but the approach often was not clear to people from a practical view. And also, the existing studies on safety regulations did not provide a comprehensive and systematic framework for the reforms. In this context, this study aimed to explore regulatory reform policies more systematically and comprehensively for the health and safety sector. According to the analysis, in the area of substantial/responsive reforms, selective management is suggested, and the method and the criteria for selective management are introduced. Also in the area of procedural/responsive reforms, sunset laws for reviews, post-regulatory impact analysis and the procedures for selective management are suggested. In addition, in the area of substantial/proactive reforms, risk analysis and regulatory or non-regulatory alternatives are recommended, and finally, reframing the procedures for the regulatory review process and assessing unfunded mandate costs are recommended in the area of procedural/proactive reforms in the health and safety sector.
