현행 이주노동정책의 문제점과 대안

초록
한국 정부는 2003년 8월 산업기술연수제를 대체하는 제도로서 고용허가제를 도입했다. 고용허가제는 내국인 노동력을 확보하지 못한 중소기업이나 영세사업주가 이주노동자를 합법적으로 고용할 수 있도록 정부가 허용하는 제도다. 기존의 산업기술연수제가 이주노동자의 노동자성을 부정했다면 고용허가제는 이주노동자의 노동자성을 긍정했다는 점에서 산업기술연수제보다 진일보한 제도로 평가되기도 한다. 고용허가제는 2011년 5월 공공행정 부패방지 및 척결 분야에서 UN공공행정상 대상을 수상하기도 했다. 그럼에도 불구하고 노동 착취와 강제 노동, 여기서 벗어나기 위한 방법은 결국 사업장을 이탈하는 것이라는 산업기술연수제가 시행되던 때 제기되었던 문제와 동일한 문제가 고용허가제 하에서도 발생하고 있다. 또한 이주 관련 단체들과 활동가들은 여전히 ‘고용허가제 폐지, 노동허가제 도입’을 주장하고 있으며 그 요구는 더욱 커지고 있다. 본고에서는 한국에서의 이주노동정책의 변천 과정과 국가별 이주노동정책을 집어 본 후(Ⅱ,Ⅲ), 고용허가제를 중심으로 현행 이주노동정책의 문제점은 무엇인지(Ⅳ), 그리고 문제가 있다면 그 대안은 무엇인지(Ⅴ), 대안을 마련함에 있어 유의해야 할 점은 무엇인지(Ⅵ) 검토해 보기로 한다.
Abstract
The Korean government introduced The Employment Permit System as an alternative to The Industrial Technology Training System in August of 2003. In the Employment Permit System, the government permits small and mid sized enterprises or small-scale businessmen, which can not secure labor domestically, to legally employ migrant laborers. The Employment Permit System is evaluated as a more advanced system in that it admits the labor power of migrant laborers while the pre existing Industrial Technology Training System denied the labor power of migrant laborers. The Employment Permit System won a grand-prix of UN public administration award in corruption prevention and transparency in public administration in May of 2011. However, laborers are still compelled to leave their place of employment to escape exploitation and forced labor. The Employment Permit System, in its execution, has the same problems as the system that it replaced. Also, migration organizations and activists are insisting on the abolition of the Employment Permit System and the introduction of a Labor Permit System, and this demand is growing larger. This study speculated on the transitional process of the migrant labor policy in Korea and foreign migrant labor policies(Ⅱ,Ⅲ), problems with the present migrant labor policy centering on the Employment Permit System(Ⅳ), alternatives to overcome the problem(Ⅴ), and cautions in developing alternatives(Ⅵ)
