중국의 지적재산권 보호와 한국 제조업의 투자입지 선택: 영과잉 포아송모델을 통한 분석

본 연구는 1989년부터 2010년까지의 기간을 대상으로 한국 제조업의 對중국 투자입지 결정요인을 성·시·자치구 단위에서 분석했다. 그 동안 이루어진 중국시장을 대상으로 한 입지선택 관련 연구들은 주로 경제적 요인에 초점을 두고 있으며, 제도의 역할에 대한 고려가 부족하다는 한계를 안고 있다. 본 연구에서는 제도요인 중에서도 주요 투자입지 선택 결정요인 중 하나로 간주되는 지적재산권 요인의 역할에 대해 살펴보고 있다. 그 동안 해외투자와 관련된 국가선택 관련 연구에서 지적재산권의 역할에 대해서는 분석이 있어 왔으나, 한 국가 내 하부 지역을 대상으로 입지 선택에 있어서 지적재산권의 역할을 분석한 연구는 전무한 실정이다. 특히 본 연구는 국가 단위 연구에서도 다루어지지 않은 지적재산권 보호를 위한 법 실행의 역할에 대해 살펴보고 있다. 31개 성·시·자치구에 대한 한국 제조업체의 투자 건수를 종속변수로 한 영과잉 포아송 회귀분석 결과, 특허 등록과 IPR 소송 변수는 한국기업들의 對중국 투자입지 선택에 유의한 정의 영향을 미치는 것으로 나타났다. 이러한 결과는 투자금액을 종속변수로 한 분석에서도 동일하게 나타났다. 이를 통해 형식적인 지적재산권 보호뿐만 아니라 실질적인 지적재산권 보호를 위한 높은 법 실행 수준이 투자 입지 결정에 있어 중요한 역할을 하고 있음을 확인할 수 있었다. 기타 변수의 경우 시장크기가 클수록, 임금수준이 낮을수록, 사회하부구조 발달 수준이 높을수록, 그리고 경제기술개발구가 많은 지역일수록 상대적으로 더 많은 한국 기업들을 유인함을 알 수 있었다.
Abstract
This study investigated the determinants of Korean firmsʼ sub-national level location choices in China for the period between 1989 and 2010. Most research on location choice in China has focused on economic factors rather than the role of institutions. This study analyzed the effect of intellectual property rights (IPR), considered a main determinant in the location choice of FDI firms. Some studies on FDI firmsʼ host country selection have analyzed the role of IPR, but few have investigated IPR effects at the sub-national level. This study investigated the role of law enforcement in protecting the IPR concerning the location selection of Korean firms in China. The dependent variable is the number of Korean FDI manufacturing firms in 31 regions in China. Using the zero-inflated Poisson regression model, we found that the patent registration and IPR litigation variables had statistically positive effects on Korean firmsʼ location choice in China. Similar results were obtained with investment amount used as the dependent variable. We therefore inferred that not only the formal protection of IPR but also a high level of law enforcement protection were the determining factors in FDI location choice. Among other independent variables, a larger market size, lower wage level, higher infrastructure development level, and more special economic zones (SEZs) in a region motivated significant inflows of Korean firms into a region.
