다문화가정의 미성년 자녀 탈취에 관한 연구

As the movement of people between countries increases due to both globalization and the development of transportation and communication, the number of international marriages is also increasing. Accordingly, various social problems have arisen as the result of the break-down of these marriages. Recently, there was a case in which a spouse took their children out of the country whilst in the middle of divorce proceedings. Similar cases are highly likely to occur in the future. Fortunately, “The Convention on the Civil Aspects of International Child Abduction” has come into force in Korea following the enforcement of the Hague Convention on International Child Abduction on March 1, 2013. In order to examine issues related to the parental abduction of minors in multicultural families in Korea, this study attempts to investigate the relevant international and domestic laws. Important matters regarding the implementation of the convention on child abduction in Korea are also reviewed. The convention on child abduction has a limitation in that it is applicable only to those countries that have joined. Because many of the major countries involved in international marriage in Korea have not joined, this study proposes that it is necessary to constantly urge those countries to do so in order to resolve the issue of child abduction in multicultural families.
