스마트폰 애플리케이션을 통한 재현적 개인정보 누적성과 개인정보보호 정책적 함의

본 논문은 스마트폰 애플리케이션 환경에서 새로이 등장한 개인정보 유형으로서 재현 가능한 개인정보의 누적 현상을 밝히고, 관련 개인정보와 정책을 분석하며 현재 개인정보 보호정책의 문제점을 밝힌다. 제2장에서 애플리케이션의 등장 이전과 이후의 개인정보를 구별적 개인정보와 ‘재현적 개인정보’라는 개념을 통해서 살펴본다. 제3장에서는 애플리케이션에서 개인정보가 어떻게 지속적으로 습득 및 누적되고 활용되는지를 사용자의 선택성 측면에서 살펴본다. 제4장에서는 현재 스마트폰의 개인정보 보호정책으로서 구글과 애플사 등 애플리케이션 장터 운영자들의 약관 및 정책과, 개별 애플리케이션들의 약관 및 정책 현황을 살펴보고 새로운 재현적 개인정보의 출현과 관련된 문제점을 고찰한다. 장터 운영자들은 운영체계의 안전성을 제외하고는 비 개입 정책을 취하고 있으며, 그 결과 대부분 애플리케이션들의 개인정보보호 관련 약관이나 정책이 없거나 제공되지 않았다. 결론적으로 기술발달에 따른 개인정보의 오남용을 막는 정책으로서는 먼저 애플리케이션 사업자와 장터 사업자의 적절한 개인정보 보호 정책이 필요하며 둘째 모바일 애플리케이션을 통한 새로운 재현적 개인정보의 누적 현상에 걸맞는 새로운 개인정보 보호 정책이 필요하다.
Abstract
This paper investigates private personal information in mobile applications running on smart phones and reveals a characteristic and implication of continuous accumulations of ‘representable personal information’ as a newly appearing personal information type in mobile application environment. On this problematique we categorize conceptually personal information types before and after the appearance of mobile application in chapter 2. In chapter 3 we find out how applications continue to gather personal information from users and accumulate it continuously with various processing. This continuous accumulation of representable personal informations bases basically on non-disclosure & exemption privilege situation of service terms and policies of each applications and its market providers such as Google and Apple, which we analyse critically in chapter 4. In the conclusion we offer a need of new policies of privacy protection relevant to the continuous accumulation of representable personal informations through mobile application services.
