A Broadcasting is an indispensable element in freedom of expressions and realization of democracy and a deciding factor information of public opinions. It profoundly influences the development of political and social democracy. The constitutional should scrutinized, since the 'Television Broadcast receipt fee' is the principal financial source for the public broadcasting and therefore an essential and important issue to be decided in realizing the freedom of broadcasting. Also, The television broadcast receipt fee is a special contribution fee imposed only on those who own television sets. Its imposition and collection limits fee-payers's right to property. In this article this problem is, firstly, structured in regard to the legitimacy of the broadcast receipt fee. Although the amount of the fee is determined by the legislature itself, a current decision structure should be structured in order to conform that the unconstitutionality will cut off the principal financial source for the public broadcasting and threaten its existence, causing a social disruption and profoundly undermining the freedom of broadcasting. To enhance the effect of the television broadcast receipt fee for the public broadcasting's existence and development, the most urgent problem is to ensure the political independence of the current television broadcast receipt fee system. Because the conflict of interest in cooperation with political forces has become an obstacle to the realization of the television broadcast receipt fee system. To ultimately resolve the problems, a professional independent body from economic and political interests, can be guaranteed the independent status. Role of the professional independent body is to determine the proper receipt fee for the public broadcasting. As a result, through the financial resources normalization of public broadcasting, ultimately, is going to be presented with a desirable development direction of public broadcasting.
