스포츠 경기 조작 실태 관련 법적 고찰을 통한 비리척결 개선방안

The purpose of this study is to seek out measures for improving the actual conditions of sports game manipulation by reviewing the actual conditions of cases of sports game manipulation which delude the affection and trust of many sports fans and damage sportsmanship and fairness, the heart of sports games. In conducting this study, details of court judgments dealing with sports game manipulation cases nationwide that have been handed down between March 2010 and December 2014 were analyzed. The contents of this study is first comprised of investigations on the actual conditions of sports games by sports type. Second, the study looks into the cause for such sports game manipulation and, finally, explores preventive measures to eradicate sports game manipulation. The actual conditions of sports game manipulation included forms of sports game manipulation where the players, coaches and referee received illegal requests and unlawful gains in cash and property. As a result, the players intentionally allowed the team to lose as the player illegally placed a high amount bet on its team losing. The reason for the reoccurrence of sports game manipulation is the high stakes winnings of illegal sports betting circles, poor sporting environment and inadequate treatment of sports players, distorted sports education provided to elite athletes, injuries and performance slumps and lack of education and training regarding sports ethics. The measures for improving the actual conditions of sports game manipulation proposed in this study include preventive education and training against bribery and corruption, implementation of Korea Sports Promotion Act which provides for severe punishment, crackdown on illegal sports betting sites, increased police investigations into sports game manipulation cases, systematic management through the fair sports commission, etc. and improvement of treatment of players and sporting environment.
