원격의료는 의사와 환자 사이에 대면으로 이루어지는 통상적인 의료행위와는 달리 비대면인 상태에서 다양한 원격장비를 이용하여 의료행위가 이루어진다는 점에 차이가 있다. 원격의료와 관련하여 다양한 정책을 시도하고 있는 미국의 캘리포니아주는 최근 원격의료에 관한 법제를 개편하였다. 그 중에서도 ‘원격의료(Telemedicine)’를 ‘원격보건(teleheatlh)’으로 대체하고, 설명의무에 관한 규정을 수차례 개정하였다는 점에 특징이 있다. 우리나라에서도 원격의료에 관한 개정을 위한 시도는 계속되고 있다. 그런데 2014. 4. 2.자 의료법 정부개정안도 원격의료의 유형을 정비하고 구체화하였지만 원격의료와 관련한 설명의무에 대해서는 규정을 두고 있지 않다. 그러나 우리나라의 경우 일반 의료행위에 관한 설명의무의 규정이 없다고 하더라도, 원격의료가 지니고 있는 구조적 특이성에 때문에 그에 관한 설명의무에 관한 규정은 필요하다고 보인다. 또한 그 설명의무의 내용도 위 개정안에서 제시한 유형에 따라 구체화 할 수 있을 것이므로 본고에서 이를 검토하기로 한다.
Abstract
Unlike the ordinary medical services which requires a face-to-face meeting between a doctor and a patient, telemedicine provides medical services without such a face-to-face meeting by using various remotely operated equipments. The State of California. which has been experimenting with various telemedicine related policies, has recently revised the law directed to telemedicine. Especially, change of the term from 'telemedicine' to 'telehealth' and several revisions for duty of explanation is worthy of noting. Korea also continues with its efforts to revise the bill for telemedicine. Although the April 2, 2014 Medical Law Revised bill has finely tuned and materialized the categories of telemedicine, it does not provide the regulation for duty of explanation. Although the ordinary medical services do not have regulation for duty of explanation, telemedicine should have a regulation for duty of explanation due to its structural particularity. In addition, the details for duty of explanation can be materialized for each of the suggested categories of the revised bill.
