조약의 국내법상 지위와 고시류조약
Status of Treaties in Domestic Legal System and Treaties Effected by a Notice

초록
조약은 헌법 제6조 제1항에 의하여 국내법과 같은 효력을 가진다. 그러한 조약들 중 헌법 제60조 제1항에 의하여 국회의 동의를 필요로 하는 것들은 국내법상 법률과 같은 효력을 가지며 그 외의 비동의조약들은 대체로 그 하위의 법규명령과 같은 효력을 가지게 된다. 이러한 일반적인 조약들과 체결절차가 다른 고시류조약의 국내법상 지위와 효력은 ‘법규적 효력을 가진 행정규칙’의 개념을 적용하여 설명할 수 있다. 형식적으로는 행정규칙으로 제정되었으나 내용적으로 법률의 보충적 성질을 가지거나 해석규칙 및 재량준칙 등 법령의 집행을 위한 것으로서 대외적인 구속력이 인정되는 경우 행정규칙도 법규적 효력이 인정된다. 고시류조약의 경우에도 헌법 제6조 제1항의 공포의 요건을 충족하지 못했고 체결절차의 측면에서 형식적으로 행정규칙과 유사하여 국내법적인 효력을 인정할 수 없으나, 내용과 효력의 면에서 보면 국민의 법적 지위에 변동을 주는 효력이 인정되므로 국내법적으로는 ‘법규적 효력을 가진 행정규칙’과 유사한 것으로 볼 수 있다.
Abstract
According to Article 6 (1) of Constitution, treaty have the same effect as the domestic laws. The treaties of which the National Assembly have the right to consent to the conclusion and ratification in Article 60 (1) have the status of the act and the other treaties have the position of the administrative rules and regulations. The procedure of making the treaties effected by a notice is different from general treaty-making process. The treaties effected by a notice is not promulgated and there is no special legal procedure for making. Formally, it could be said that the treaties effected by a notice would have the status of the administrative regulations without legal-effect. But the Korean courts have admitted that the administrative regulations have legal effect in some cases. For example, when the act would be complemented by the regulations, the regulations should have the legal effect. Similarly, as the government has obligations to abide by all kinds of the treaties including treaties effected by a notice, we cannot deny the domestic legal effect of the treaties effected by a notice. So, the treaties have administrative regulations with regal effect in domestic legal system.
