경제민주화 정책에 대한 헌법적 평가

In Korean society, the debate over the issue of the Economic Democratization has heated up since the 19th General Election and the 18th Presidential Election in 2012, and it has led political parties to propose many different policies among which are the Reformation of the Chaebol, the Accompanied Growth, etc. However in order to assess such policies, it is proper to begin with interpretation of the Constitution since there is an article which directs explicitly to the Economic Democratization. Considering the prior amendment procedure and the Article's relationship to Article 119 Paragraph 1 of the Constitution, the Economic Democratization Article holds the meaning of supplementation and modification to prevent adverse effects of market economy. Therefore, it is not proper to interpret the Article in the perspective of market economy. Rather, the Economic Democratization needs to be understood as the actualization of Korea's constitutional economic order, which is generally known as the social market economic order. In this respect, the Economic Democratization policies offered by the current government and political parties can be viewed as putting too much emphasis solely on market economy perspective, and such leads to the lack of actual policies which accord with the social market economic order.
