고령화 사회 정보 평등과 입헌민주주의 - 디지털 양극화(digital divide) 극복의 당위성을 중심으로 -

초록
정보통신 기술이 비약적으로 발전하면서 민주주의의 형태 또한 현대적으로 발전해 가고 있다. 소위 전자민주주의라 불리는 새로운 모습의 민주주의는 우리 헌법이 담고 있는 민주주의의 원리에 의해서 얼마든지 그 수용이가능하다. 민주주의 작동을 위한 언론활동, 의사소통, 민주적 토론 등의 과정이 온라인상에서 이루어지고 있으며, 최종 판단을 위한 여론이 주로 전자적 통로를 통해서 형성되고 있다. 대한민국의 민주주의가 정보통신기술의 현실 위에서 현재 가동되고 있는 것이다. 이러한 상황에서 민주주의 참여자로서 국민들이 가지는 정보에 대한 평등, 나아가 정보기술의 평등한 사용 권한이 중요하게 다가온다. 정보화가 진전되기 이전에도 정치적 의사의 합의가 쉽지 않았던 우리 사회는, 정보 기술 발전과 함께 그 의사가 더욱 양극화되는 현상을 보이고 있다. 필자는 이 현상의 원인에 디지털 양극화, 즉 정보 불평등의 심화가 중대하게 기여하고 있다고 본다. 민주주의의 전제가 되는 숙의의 과정에 정보를 공평히 가지지 못하는 참여자가 두드러지게 존재한다면, 이는 민주주의의 성공을 가로막는 중대한 문제점이 될 수밖에 없다. 특히 고령화가 급속도로 진행되고 있는 과정에서, 공교롭게도 고령자 계층의 디지털 양극화가 심한 현상과, 우리 민주주의에서 세대별 정치 의사가 특별히 고령자 계층을 중심으로 극렬한 분화를 겪고 있는 현상이 동시에 일어나고 있다는 현상에 주목하였다. 민주주의의 작동 구조와 우리 민주주의현실을 고려할 때 이들 현상이 규범적으로 유의미한 연관성을 가진다는 추론이 가능하며, 이를 근거로 정보 평등에 관한 헌법적 당위를 이끌어 내었다. 고령자 계층의 디지털 양극화 문제가 우리 민주주의의 성패를 좌우할정도의 중요성을 지닌다는 점을 지적하였고, 그 시정과 보완의 정책 방향이 시급히 이루어져야 한다는 점을 주장하였다.
Abstract
With a quantum leap of digital communication technology, our democracy has developed into a contemporary model: electronic democracy. This new format can be accepted by our constitution where democracy is a working principle. Now, we communicate, debate, and make public opinions for democratic decision makings online. Electronic democracy of Korea activates itself based on the current technology. Surrounded by technological circumstance of democracy, the participant’s equality on the access to information and the usage of information technology bears significant meaning. The Korean society has had a hard time making a matured process of political consents. This hardship has been deepened even after the technological development: the dichotomy of political opinions became more serious. The writers view the reason of the aggravated dichotomy from the digital divide between the elderly and the others. Democracy cannot properly work if there are manifest participants who have limited access to information for deliberation. Furthermore, the Korean society undergoes aging. The digital divide coincides with the dichotomy of political opinions between the elderly and the other generations in Korean democracy. This article tries to present a solution for this problem: building an agreed society by correcting the digital divide. The writers diagnose the serious dichotomy of opinions between the elderly and the others from the problematic digital divide. Based on the state’s constitutional duty to solvediscrimination, the writers argue the state should solve the digital divide as an emergent national project for our working democracy.
