우리나라 동물보호법제의 문제점과 개선방안에 관한 고찰

현행법상 동물보호에 관한 내용을 담고 있는 법률로는 「동물보호법」, 「한국진도개 보호 육성법」, 「야생생물보호 및 관리에 관한 법률」, 「자연환경보전법」, 「환경영향평가법」, 「독도 등 도서지역의 생태계 보전에 관한 특별법」, 「문화재보호법」 등이 있다. 하지만 현행 동물보호관련 법령들은 국민들의 동물에 대한 인식변화를 제대로 따라가지 못하고 있고, 동물보호를 위한 규율 내용과 법령 체계도 미흡한 점이 존재한다. 또한 동물보호 관련 업무는 농림축산식품부, 환경부, 문화재청 등으로 분산되어 있어 업무의 유기적 연계가 부족한 상황이다. 이러한 점들로 인하여 동물보호법제의 체계적이고 통일적인 정비의 필요성이 증대되고 있다. 한편 현행 동물보호법제의 체계적인 정비의 필요성은 동물복지 이념의 대두와도 밀접한 관련이 있다. EU의 동물보호법제는 기본적으로 동물을 ‘지각있는 존재’로 이해하고, 동물을 ‘보호’의 대상에서 보다 적극적으로 ‘복지’의 대상으로 파악하면서 동물복지를 보장하기 위한 법적·제도적 장치를 마련하고 있다. 우리나라에서도 최근 동물에 대한 인식변화와 맞물려 동물복지를 반영한 입법의 변화를 요구하는 목소리가 커지고 있다. 이러한 시점에서 우리나라의 동물보호법제의 현황과 문제점을 살펴보고 이에 대한 개선방안을 검토하는 것은 의미있는 일이라고 본다. 본 논문은 논의의 범위를 명확히 하기 위하여 동물보호법제의 의미, 보호대상으로서의 ‘동물’, ‘보호’의 의미, 동물보호법제의 범위와 주요 내용을 살펴보고 있다. 이를 토대로 하여 우리나라 동물보호법제의 문제점을 분석하여 바람직한 개선방안은 무엇인지 검토하고 있다. 우선 현행 동물보호관련 법령에서 동물복지에 대한 인식을 보다 제고하여 이를 법령에 반영시킬 필요가 있다. 그리고 동물보호법과 그 외 동물보호관련 법령들이 서로 정합성을 확보해 갈 수 있는 입법적 개선방안도 검토하는 것이 필요하다. 또한 동물보호법의 실효성 확보와 규율공백 해소를 위한 방안도 검토할 필요가 있다.
Abstract
This paper aims to review the legal study on Improvement for Animal Protect Legislation in Korea. In this paper, I review a Animal Protect Legislation System in Korea, and then I try to analyze legal system and animal policy, to suggest improvement of Animal Protect Legislation. In 1991, Korea enacted 「Animal Protection Act」. But in reality it was a paper tiger. This act lacked of concrete and actual regulations for animal protection. It was after 1990 that people started to have an animal right activist’s mind, and established many animal protection groups. This movement resulted major revision of the law in 2007 and 2011. But this amended act were mainly focused on regulation and management of central and local governments. Still leaves many issues to be to be solved. The purpose of this Act is to protect life, ensure safety, and promote welfare of animals by providing for matters necessary for the prevention of cruelty to animals and for the protection and appropriate management of animals, thereby develop national ethos, such as respect for the life of animals. In Korea, the legal problems and issues concerning animal protection are in a starting phase. For example, the scope of animal subject to protection, animal abuse, increase of punishment, animals in research, farmed animals, companion animals, civil issue(contracts, torts etc.). Such various legal problems and issues are not being examined more systematically and in depth. We have to review in these various legal problems and issues. And we have to find legal implications for the Korea animal law and policy.
