한국의 정치자금법제 개선방안 - 법인, 단체의 정치자금 기부허용과 사후 투명성강화를 중심으로 -

초록
국민의 정치적 표현의 자유 역시 선거의 공정성 등을 이유로 일정한 제약을 받으므로 정치적 표현의 자유와 선거(정치)의 공정성 확보 사이에서 충돌하는 양 법익의 조화로운 해결은 대의제 민주국가에서 매우 중요한 헌법적 쟁점에 속한다. 우리나라는 그동안 정치자금에 대한 엄격한 사전규제를 강조하였고 그로 인해 자유민주주의 이념과 헌법상 정치적 표현의 자유의 위축 문제가 일부 초래한 것도 사실이다. 본 연구는 이러한 문제를 비교법적 검토를 통해 지적하고 앞으로 우리가 나아가야 할 바람직한 방향은 무엇인지에 관하여 고찰해 보았다. 결론은 이렇다. 선거비용과 정치헌금 등 정치관련 비용의 상한액이 낮은 수준에서 정해져 정치적 형평성이 보장되고 선거의 공정성이 강화되는 것처럼 보여질 수 있으나, 신인 정치인이나 소수정당이 경쟁력을 갖고 현직 의원이나 거대 정당과 경쟁하기에는 규제와 한계로 작용되고 있다. 또한, 21세기 인터넷 혁명시대에 단순히 금권선거와 정경유착을 지나치게 염려하는 것은 우리 국민 수준을 너무 낮게 보는 것이다. 결국 기업체 등 법인과 단체의 정치자금 기부 등 정치 활동을 제한적으로 허용할 필요가 있고, 그 일환으로서 정치자금 기부금지 규제를 해제하고, 기부금액 역시 현실적 정치 상황에 맞게 상향 조정하는 대신 그 사용처 등 투명성을 강화하는 세계적인 추세로의 전환이 우리 정치자금법제에도 필요하다고 할 것이다.
Abstract
