Hyper-Constitutionalization of Civil Cases in Korea - Focusing on Property Law Cases -

The constitutional court of Korea is the specialized highest court which has overall authority for constitutional issues. The supreme court of Korea as the general highest court also plays certain role in reviewing the constitutionality of laws and lower laws. This dual constitutionality review system has caused severe conflicts between the two highest courts, and brought considerable legal instability in Korea. Indeed, the hyper-constitutionalization phenomenon is an example of the abusing constitutional lawsuits by people under favor of the conflicts. As a solution, the author suggests the merger of the supreme court and the constitutional court into one big multi-supreme court.
