외국인 이주자와 범죄: 상징적 폭력과 차별

이 연구는 외국인 이주자에 대한 차별이 그들의 범죄에 주요한 영향력으로 나타나는지를 살펴보고자 한 것이다. 주된 분석은 두 가지 방향으로 제시되었는데, 첫 번째는 외국인 이주자의 범죄가해 여부에 대한 것이고 두 번째는 범죄 빈도에 대한 것이다. 이 분석을 위해 2013년 실시된 외국인 이주자의 생활실태조사 자료를 사용하였다. 분석결과 여성보다 남성이, 교육수준이 낮을수록 그리고 거주환경이 나쁠수록 범죄행위를 할 가능성이 높았다. 특히 범죄피해의 경험이 많을수록, 그리고 일상생활에서의 차별경험이 많을수록 범죄행위를 할 가능성이 더 높은 것으로 나타나서 본 연구의 가설이 지지되었다. 그리고 범죄가해자를 대상으로 한 범죄빈도의 경우에도 차별경험이 뚜렷한 영향력을 보였다. 따라서 차별경험을 많이 할수록 범죄행위를 할 가능성도 높고, 동시에 범죄의 빈도수도 더 많아졌다. 이러한 사실에 기초하여 외국인 이주자의 범죄는 차별에 대한 하나의 반응로 발생할 수 있다는 것을 알 수 있었다. 분석결과에 대하여 부르디외의 아비투스와 상징적 폭력의 개념을 중심으로 논의를 시도하였다.
Abstract
This study analyzes the effects of discrimination against foreign migrants on their crime. This study deals with two different dependent variables, one is the involvement in criminal activities of foreign migrants, and the other is the frequency of criminal activities of foreign criminals. Data for this study came from a sample of survey on the living condition of foreign immigrants conducted in 2013. The results show that gender, education and living environment of foreign migrants affect the involvement in criminal activities of foreign migrants. Especially, foreign migrant victims of crime are more likely to involve criminal activities. Also, experiencing more discrimination is more likely to turn foreign migrants into criminals. For foreign criminals, people who have more experiences of discrimination are more likely to commit crime. These results supported research hypotheses in terms of criminal activities of foreign migrants as reactions of discrimination against them. These results are discussed focusing on Bourdieu's theory of habitus and symbolic violence.
