中国不动产物权登记的法律适用 : 以他人名义购房引发的思考

以他人名义购房是这几年随着房地产政策的调整才不断出现的社会现象,由此引发的权属争议纠纷案件该如何处理,无论在理论界还是司法实践中都相对讨论和处理得比较少,属于社会问题法律化的典型表现。多数处理意见都是依产权登记认定名义产权人为实际权利人,主要是顾虑该处理规则与物权法登记制度的规定相违背。由此可见,在如何看待该类案件的法律关系性质以及其所包含的相关法学理论内涵,并正确合理的运用法学理论处理案件是各级法院在审理该类案件过程中必须明确的问题。因为案件处理的结果关乎真实权利人的切身利益和维护社会交易的安全、稳定,所以必须确保审判结果的公平和公正,而最公平公正的正是使结果尽可能的接近事实的真实状态。 本文正是基于上述问题在理论上和实践中的争议,着眼于切实保护权利人利益的观点出发,对以他人名义购房的权属争议案件所蕴含的法学理论内涵及司法适用规则进行详细论证。笔者认为,抛开产权登记记载绝对性的偏见,着眼于证据的审查,从举证责任的角度辨别真权利人的权利性质,从法律上尊重真权利人的权属地位,不仅不违背物权法的规定,而恰恰是不动产物权登记制度在司法实践中的价值体现和精神所在。进而,笔者对该类案件的司法裁判规则作了简单的归纳和说明,以期对同类案件的合理审判有所裨益。
Abstract
In recent years, due to the macro-control of the real estate made by Chinese government, a series of legal issues related to property registration system of real estate when people purchasing real estate in the name of others has became a hot issue in the judicial trial. Meanwhile, people who are doing the housing registration are usually inconsistent with the real rights holders. That makes property disputes gradually been concerned by the whole community in China. This article makes statements about the legislation of property registration of real estate, application of real estate property registration in judicial registration system, judicial examination system of property registration, as well as judicial rules about ownership disputes when people purchasing real estate in the name of others with legal theoretical analysis and operation details in judicial practice. Especially, this article focuses on the registration examination system and related contents, such as methods of registration examination system, legal nature of registration, judicial examination registration by authorities, right relief for the wrong registration by parties, etc. From the perspective of protecting the interests of real housing rights holders, this article hold the view that, when dealing with similar cases like the party has sufficient evidence to claim being the real property holder in the judicial practice, the court should make efforts to exam both evidence and civil legal relationship ,combing with the theoretical analysis mentioned above to determine the final real property owner, in order to protect the legitimate interests of the rights holder.
