여성체육 관련 스포츠 법제의 검토

In the Republic of Korea, all areas of School sport field, professional athlete field, life sport field a need to review the equal opportunity for Gender. Until now, sports in general had serious issues regarding equal opportunity in gender, sexual violence and sexual harassment. It is necessary to review legally for gender equality in all sport areas in the wake of the ‘Framework Act for gender equality’ to be implemented in July 2015. This study reviews the provisions of the Constitution and the Korean Olympic Committee Rule and sports-related legislation for the realization of gender equality in the field of physical sport education, and presents some solutions as opinions. Furthermore, this paper reviews the right to enjoy sports, the right to education, the right to be healthy, and the new physical education-related discussions of equality and together with fundamental rights. This paper researchs Title Ⅸ, the United States Education Amendments of 1972 Act, in the background of these discussions. Also Framework Act on Education, National Sports Promotion Act, the School Physical Education Promotion Act, 'Life Sport for Promotion Act was reviewed. In addition, the Korean Olympic Committee Rule is reviewed, including the Athletes Council Regulation. Hence, I suggests that National Sports Promotion Act should amend the Framework Act on National Sports by strengthening the gender equality, and also the Korean Olympic Committee Rule will add the provisions to appoint women representatives in various committees such as the Athletes Council Regulation. It emphasized the need for additional activities for the activation of the role and function of athletes regarding Civil Rights Center . And how to achieve more gender equality, education and awareness, so that these would lead to changes in the culture of athletics, and will be a change of the relevant legal regulations for a means of securing of such efforts.
