초록
정보통신기술의 급격한 발전으로 인해 형성된 사이버스페이스는 그동안 인지되고 있던 시간과 공간에 대한 관점을 새롭게 정립시켰다. 이처럼 인터넷을 기반으로 만들어진 새로운 활동공간은 국가에게는 안전과 질서를 개인에게는 자유로운 활동의 보장이라는 측면에서 인식되었다. 초기의 인터넷 공간(온라인)은 개인이 제한 없이 자신의 창조적인 생각을 표현하고 이러한 표현을 오프라인 상으로 실현시킬 수 있게 해주었다. 이처럼 인터넷을 통해 형성된 사이버공간 상의 이용자정보는 민간사업자 등에 의해 손쉽게 수집‧이용되어져 전자상거래시장의 폭발적인 성장에 커다란 인자가 되고 있다. 그러나 민간사업자에게 경제적 활용가치가 높은 이용자정보는 그 매력적 요인으로 인해 이용횟수 및 수요가 기하급수적으로 증가하면서 이용자의 개인정보에 대한 오‧남용의 문제는 물론 해킹과 같은 범죄로까지 확장되는 양상을 보이고 있다. 이처럼 개인정보와 관련해서 언제 어디서든 예고 없이 자행되는 개인정보의 유용과 해킹 등으로 발생하는 경제적, 신체적 침해는 전 사회적으로 개인정보침해에 대한 공포감을 촉발시켰다. 이에 따라 정부는 개인정보 침해문제에 대하여 강도 높은 보호의 필요성을 절감하고 지금까지 행정규제 일변도로 몰아가고 있는 상황이다. 행정규제만으로는 발달 수준을 예측하기 어려운 과학기술의 진보와 혁신과 사회분화로 대별되는 미래 교류의 장에 대한 효과적 접근에 대한 제한을 내포하고, 국가 간의 경계와 같이 지역적 제한으로 인한 개인 간의 교류한계를 효과적으로 극복할 수 없다. 이의 대안인 개인정보보호에 관한 자율규제는 각 사업자가 규제기준을 비교적 빠르게 개발하도록 해 주고 현실적합성의 확대를 도모하는 측면에서 검토할 필요가 있다.
Abstract
Cyber space caused by rapid development erects new perspective about time and space. The new activity spaces are recognized as guarantee of stability and order to nation and of free activity to individual person. Early online spaces make individual people express their opinion and realize this expression in offline. User informations cause explosive growth of e-commence owing to easy collection exploitation by private business operators. But this user informations exponentially increase in use and demand for its economical value and expand not only abuse about personal informations but also crime such as hacking. Economical, physical violations which occur misuse and hacking of personal informations without forewarning trigger socially fear about infringement of personal informations. So, government realizes acutely necessity of intensive protection about infringement of personal informations but only with administrative regulations are used to solve the problems. However, only with administrative regulations are limited to effective access about spaces for exchange because of unpredictably advance of science technology and regional limitations such as frontier that causes individual exchange limitations. That is, voluntary restraint of personal informations need to consider because it makes standard for control develop comparatively promptly to business operators and enlarge combination.
