제주특별자치도 감사위원회의 독립성을 위한 모형정립과 법적고찰

초록
제주특별자치도 감사위원회가 출범한지 이제 10년을 맞이했다. 감사위원회는 원칙적으로 중앙정부로부터의 감사를 배제하고, 감사의 독립성, 전문성, 책임성을 강화시켜 고도의 자치권이 부여된 제주특별자치도 이념에 부합하는 자율적인 감사체계를 구축을 목표로 하고 있다. 그러나 출범 이후 감사의 성과, 학계의 지속적인 연구, 제주특별자치도의 제도개선에도 불구하고 감사위원회의 조직, 감사위원회의 직무, 그리고 감사위원회의 재정 독립성에 관하여 많은 문제점들이 도출 되고 있다 따라서 제주특별자치도 감사위원회가 향후 전국적으로 확산 실시되어지는 자치 감사기구의 모델이 되기 위한 재평가 차원에서 제주특별자치도의 설치 목적에 맞게 모형은 정립되고, 그 모형에 의해서 운영되고 있는지 그리고 독립성에 대하여 발생하고 있는 문제점 들을 해결해야할 개선 방안은 무엇인지에 관하여 깊이 있는 검토가 필요하다. 이러한 맥락에서 본고에서는 감사위원회의 독립성을 확보하기 위해서 그리고 향후 전국적으로 확산 실시되는 지방자치 감사위원회의 모델이 되기 위해서 감사위원회의 독립성을 위한 모형을 정립하고, 제주특별자치도법 감사위원회 규정의 주요 내용에 관하여 독립성을 위한 법적 개선방안을 제시 하고자 한다.
Abstract
The self-governing province Audit and Inspection Commission is launched 10 years ago. Jeju special self province Audit and Inspection Commission have purpose that it was build autonomous audit system to enforced independency and professionalism rule out audit of the government. by the way, After launched, the self-governing Audit and Inspection Commission had estimate successful itself. owe to result of inspection, academic study, improvement to self-governing Audit and Inspection Commission but it is well known of managemental issue that relation to independency. So now, reestimate in a dimension about self-governing Audit and Inspection Commission, the self-governing Audit and Inspection Commission would be introspect oneself that model agree to purpose of self-governing Audit and Inspection Commission, and what is improvement plan about problems. as such, Jeju special self-governing province type model, would be improvement system agree to its model. Therefore, in this study 1t was review and analyse about model of self-governing Audit and Inspection Commission presented to Jeju special self-governing province type model and it was considerate on legal improvement agree to model about the major issue come out in the management status, for that the self-governing Audit and Inspection Commission for the purpose of doing settled more successful system, and in order that model for enforce to on a national scale.
