제1기 헌법재판소 김양균 재판관의 판결성향 분석

1988년 9월에 구성되어 6년간 활동한 제1기 헌법재판소는 군사정권이 물러간 이후 봇물처럼 터져 나온 국민들의 민주화 열기를 헌법재판에 잘 담아내며 전에 없던 사법적극주의적 판결을 통해 우리 헌법재판을 단단한 초석 위에 올려놓은 재판부로 평가받는다. 본 연구는 이 제1기 헌법재판관 중에서도 24년의 오랜 엘리트 검사 생활 끝에 노태우 당시 대통령에 의해 헌법재판관으로 임명된 김양균 헌법재판관의 판결성향을 정성분석과 정량분석을 통해 분석해내는 것을 연구의 목적으로 삼는다. 이를 위해 우선 김양균 헌법재판관의 주요 경력과 행적을 제1기 헌법재판관으로 임명되기 이전과 이후로 나누어 상세히 살펴보았다. 또한 김양균 재판관이 제1기 헌법재판관으로 재직하는 동안 관여했던 주요사건들 중에서 그의 판결성향이 비교적 잘 드러나는 대표적인 사건들을 정치, 경제, 사회·문화의 분야별로 선별하여 정성적으로 분석하고 평가해 보았다. 또한 김양균 헌법재판관이 제1기 헌법재판관으로 재직한 6년 동안 관여했던 모든 전원재판부 사건들을 대상으로 정량분석도 시도하였다.
Abstract
This paper aims at analyzing the judicial inclination of the Justice Yang-Kyun Kim in the First Korean Constitutional Court who was appointed as a Justice by the President Tae-Woo Rho and had been an elite public prosecutor for 24 years before the appointment. To achieve the aim, this paper will examine the life path and the judicial career of the Justice Kim before and after his appointment in the Court. Then, it will qualitatively analyze his opinions as a Justice in the Korean Constitutional Court through the four major cases representing political, economic, social and cultural fields. In addition, this paper will also quantitatively analyze his whole opinions based on the statistics. For these analyses, the analytical frames such as ‘judicial activism v. judicial passivism’ and ‘judicial progressivism v. judicial conservatism’ will be applied.
