조망권의 성립 및 침해에 관한 연구

초록
영업용 건물에서 경관조망 및 주거용 건물에서 시야조망, 경관조망은 중요하다고 볼 수 있다. 그런데 조망권의 성립과 침해의 기준이 명확하지 아니하므로 이와 관련하여 다툼이 있을 수 있다. 그래서 이 연구를 통하여 조망권의 성립 및 침해의 기준을 구체적으로 세워 보고자 한다. 조망권이 성립하려면 조망권자의 조망이익이 생활이익으로서의 가치를 가지고 있고, 그 이익이 사회통념상 독자적인 이익으로 승인되어야 할 것이다. 이를 판단하는 요소로 지역적 특수성, 조망의 목적성과 토지이용과의 조화성, 시설의 소유, 시간적 선주를 들 수 있다. 조망권이 성립과 관련하여서는 주로 경관조망에서 문제가 되는데, 가장 중요한 요소는 조망의 대상이 조망의 가치가 있는 물건이어야 할 것이고, 그 대상이 피해건물로부터 일정한 거리 이내에 위치하여야 할 것이며, 조망이 침해당할 당시에 조망이 가능하였어야 할 것이다. 조망권의 침해는 조망이익의 침해 정도가 사회통념상 일반적으로 인용하는 수인한도를 넘었는지 여부로서 판단할 수 있다. 이를 판단하는 기준으로는 경관조망에 있어서는 조망침해율이고, 일응 조망침해율이 60%이면 조망을 침해하였다고 볼 수 있을 것이다. 시야조망에 있어서는 조망침해율도 중요하지만 그 보다 더 중요한 것은 가해건물과 피해건물의 이격거리가 될 것이다. 조망침해율이 60% 이상이고, 이격거리가 인접대지로부터 가해건물 높이의 0.5배 이내이면 조망을 침해하였다고 볼 수 있을 것이다.
Abstract
The purpose of this study is that the establishment and infringement of the prospect right. In order to establish the prospect right, the benefit of the prospect should be worth a life interest. And the interest shall be the exclusive interests on social norms. I wish to see that establishment and infringement of the standards of the prospect right through this a study. To establish of the right of the prospect of landscape shall be the targets of prospect, is the river, sea and so on. Also, the targets shall be situated within a certain distance from the building. it should be able to view when prior to the infringement at the time. In prospect of landscape, the violation rate of prospect is important, the rate will be at least 50%. In prospect of view, the violation rate of prospect is important, but more important than that will be applied to the separation distance of the harmed building and the damaged building. The violation rate of prospect is 60% and separation distance would be applied to more than double the height of the building.
