초록
TPP 협정 타결이 가시권에 들어왔다. TPP는 국제통상 질서의 재편을 초래하는 중요한 변수이다. 특히 Mega-FTA로서 그 규범 형성적 기능은 우리에게 중요한 영향을 초래할 것으로 예측된다. 이 협정에 포함되는 여러 쟁점 중 투자챕터에 포함되는 조항들은 향후 국제투자협정의 기본골격을 새로이 형성할 가능성이 매우 높다는 점에서 우리의 주목을 요한다. 특히 우리나라 입장에서는 미국과 FTA가 발효된 지 얼마되지 않은 시점에서 다시 미국과 새로운 FTA를 체결하게 되는 상황이 전개되게 되어 여기에 포함되는 투자협정이 어떠한 모습을 띠게 될 것인지는 우리에게 중요한 관심사가 아닐 수 없다. 기본적으로 한미FTA 투자챕터와 TPP 투자챕터는 동일한 골격을 유지하고 있다. 그러나 이러한 전체적 유사성에도 불구하고 TPP 투자챕터의 대두는 구조적인 측면에서 새로운 법적 쟁점을 제기하고 있으며 또한 세부적인 항목에서도 다양한 새로운 법적 쟁점을 제기하고 있기도 하다. 이들 중 일부는 우리나라에 유리한 성격의 조항도 있는 반면, 일부는 우리 정부에 새로운 부담을 초래하는 측면도 있다. 따라서 기존의 투자협정과 TPP 투자챕터가 어떻게 상이한지, 그리고 그러한 상이한 결과가 초래하는 효과는 어떠한 것인지 주목할 필요가 있다. 전체적으로 TPP 투자챕터는 여러 측면에서 TPP 체약 당사국간 기존의 투자협정에 대한 사실상의 개정을 초래한다는 측면에 주목할 필요가 있다. 우리나라 입장에서도 만약 TPP에 가입하게 되면 어떤 국가와의 투자협정이 사실상 어떻게 변경될 가능성이 있는지 면밀히 분석할 필요가 있다. 이러한 작업을 통하여 앞으로 필요한 대응책을 적극 모색할 필요가 있다.
Abstract
The Trans Pacific Partnership (TPP) is reaching the final stage for conclusion. Once concluded, this mega-FTA heralds the advent of a new trade landscape by introducing new rules for many new issues of international trade. In that regard, the TPP also introduces an Investment Chapter which sets forth rights and obligations of contracting parties and Investor-State Dispute Settlement Proceedings (ISDS proceedings) differently from those found in the existing international investment agreements. It is critical for Korea to be apprised of these differences and the consequences of such differences in terms of implementation of obligation and conduct of the ISDS proceedings. In particular, the TPP Investment Chapter includes provisions that are different from the Korea-U.S. Investment Chapter. Some of the safeguards measures that Korea purposefully included in the Korea-U.S. FTA are not found in the TPP Investment Chapter, which would mean that a U.S. investor can virtually circumvent the Korea-U.S. FTA to utilize the TPP Investment Chapter instead. So, the TPP basically stands for the possibility of a de facto amendment of the Korea-U.S. Investment Chapter. A similar situation can also take place with respect to other TPP member such as Australia or Canada. In contemplating joining the TPP negotiations either as a founding member or as a subsequent acceding country, these unique aspects of the overlapping investment chapters should be carefully analyzed. Once the pros and cons are confirmed, focus should be placed on how to implement Korea’s obligation under the complex network of investment agreements and how to respond in the increasing ISDS proceedings.
