현행 도시정비사업 법제의 몇 가지 개선 방안

초록
본 연구는 도시정비사업과 관련된 주요 선진국의 제도 및 사례를 통하여 우리가 본받을 시사점을 검토한 후 이를 통해 현재 우리나라 도시정비 사업과정에 필요한 정비기법과 제도적 개선점이 무엇인지를 살펴보는데 주안점을 두었다. 먼저, 최근 정비사업의 새로운 패러다임으로 논의되고 있는 도시재생사업은 기존의 대표적 정비사업으로서 주택재건축, 재개발사업과 별개의 분리된 사업추진 체계가 아니라 위 사업을 보완, 보충하는 정비기법임을 강조하였다. 나아가, 바람직한 형태의 도시정비는 물리적 환경개선 뿐만 아니라 해당 거주민과 지역의 생태환경 및 문화적 특성을 고려한 미래지향적 계획이 이루어져야 할 것인바, 이를 위해 현재 도시정비 사업과정에서 지나치게 강조된 공공의 개입은 다소 지양하되, 정비계획 단계부터 주민과 민간 전문가가 해당 사업에 적극 참여하는 방향으로 전환될 필요가 있다. 즉, 향후 도시정비사업은 지역 주민의 선택권과 참정권이 보장된 주민 주도형 사업방식으로서, 공공의 간섭과 지원은 정비기반시설의 건설과 사업의 투명성 감시 등에 치중하는 것이 바람직하다. 마지막으로, 도시정비사업의 효율적 추진 체계상 문제로 지적되고 있는 정부 각 부처와 지방자치단체별 정비사업 지원정책의 중복, 혼선문제를 반드시 개선할 필요가 있고 이를 위해 현재 여러 법제로 난립되어 있는 도시정비 관련 법제의 통합 내지 체계정당성 있는 개정이 반드시 필요하다는 점을 강조하였다. 이러한 관련 법제 통합과 함께 대통령이나 총리실 직속의 도시정비사업 통합본부를 설치하여 그것을 중심으로 정부 부처와 지자체 및 지역주민 상호간에 촘촘히 연계된 효율성 있는 정비사업 추진체계를 조속히 마련할 필요가 있다.
Abstract
The purpose of this study was to examine what urban living environment maintenance techniques required for our country through this after reviewing the suggestions we receive through the relevant institutions and practices of the developed countries for the city maintenance projects. First, the urban regeneration projects being discussed as a new paradigm in the recent. Urban Regeneration project is not separate systems the reconstruction and redevelopment. I emphasize that maintenance techniques to supplement. Furthermore, the preferred form of Urban Development, as well as improving the physical environment, its inhabitants and the local ecological environment and inbound will be made future-oriented planning considering the cultural aspects, the intervention of the public too stressed from the current Urban Development Legislation for this purpose is discouraged, but rather, maintenance planning steps from residents and civilian experts may need to be switched in the direction of actively participating.
