법학적성시험(LEET) 논술 채점 방식의 개선에 대한 연구

초록
현재 법학적성시험 논술의 출제는 법학전문대학원 협의회 법학적성시험 연구사업단이 담당하여 채점 기준과 해당 답안을 각 법학전문대학원에 보내고, 채점은 이 자료를 기초로 각 전문대학원에서 담당하고 있다. 이 방식에 근본적 문제가 노출되지는 않았지만 보완할 점이 없지 않기에 논술 채점방식에 대해서 개선안을 제시하는 것이 이 글의 목적이다. 현재 논술과 관련하여 노출된 문제점은 논술의 중요성에 비해 논술의 반영비율이 높지 않다는 것이다. 또한 현행 채점방식에는 두 가지 문제점이 잠재되어 있다. 첫째, 출제와 채점이 별도 기관에서 이루어지다 보니 출제자의 의도가 충분히 반영되지 못한 채 채점이 진행될 가능성이 항상 잠재되어 있다. 둘째, 출제와 채점이 분리되면서 생기는 또 다른 문제는 채점자의 의견이 출제진에게 전혀 피드백 되지 않는다는 점이다. 이 문제를 개선하기 위해 세 가지 안을 제시하였다. 첫째는 출제와 채점의 분리를 극복하여 이를 한 기관에서 모두 담당하는 안이다. 법학전문대학원 협의회에서 출제한 다음 일괄 채점하여 그 결과를 통보하는 것이다. 이 안은 법학적성시험 시행 초기에는 관리가 불가능한 것으로 판단되어 고려하지 않았지만 이제 전문적인 채점자도 상당수 확보되어 있고 채점관리방식도 개발되어 있으므로 가능한 시점이 되었다. 둘째는 출제와 채점이 분리될 수밖에 없는 현실을 인정하고 지금보다 채점자의 재량을 더 확대하는 방향으로 논술 문제의 성격을 대폭 변화시킴으로서 논술의 활용을 유도하는 안이다. 미국 LSAT에서 시행하는 글쓰기 자료(writing sample) 개념을 도입하여 각 전문대학원이 지금보다 더 자유롭게 활용할 수 있는 글쓰기 자료를 제공해 주는 것이다. 셋째는 현재 제도를 일부 보완하여, 채점을 자체적으로 하지 않고 법학전문대학원협의회에 의뢰하고자 하는 전문대학원이 있다면 이에 대해서만 협의회에서 채점해서 결과를 통보하는 방식이다.
Abstract
Currently, for essay writing in LEET, questions are in charge of Korean Association of Law Schools and each law school is responsible for the scoring. To suggest improvements to the problems of this system is the purpose of this article. It has three problems as follows. First, despite the importance of essay writing, this system prevents the portion of it from being significant in admission. Second, because of the separation of questions and grading, the risk that graders cannot fully reflect the intention of question exists. Third, the opinions of graders cannot be fed back to the question designers. I suggest three kinds of solution to improve essay scoring system in LEET that we can select. My first suggestion is that to overcome the separation of questions and grading, Korean Association of Law Schools is in charge of both. Otherwise, I propose second solution that by introducing the concept of writing sample like LSAT, each law school can use the essay more widely and variously than now. Third one is a proposal to make up for the current system partially. Only when a law school asks the scoring, Korean Association of Law Schools is responsible for it to meet the needs.
