朝鮮時代 離婚法에 비추어 본 『玄氏兩雄雙麟記』의 여성의식

HyunSsiYangWoongSsangRinKi(『玄氏兩雄雙麟記』) as a Korean classical long novel, describes the trouble between the married couple of the upper classes. In the process of the couple's discord, it is exceptionally described that heroines claim a divorce or run away from home, refusing marital relations. It could be big issue in a view considering divorce law of the Joseon era which forbade getting a divorce at national level and defined that just male could demand to bring a lawsuit for divorce. According as the disparity in rank between two heroines, a lawful wife and a concubine, the manner of divorce requirements would be different. However the same is true in that they show the resistance against the restraint of patriarchy. This novel represents ambivalently that feminine agonies and inconsistency of patriarchy are described through the refusal of marital relations, meanwhile, the solution is attempted through the acceptance of the morality in governance considering the authority of patriarch. However, the significant point is that this duality rather communicates the troubles of those days vividly which is something like problems of the system and human, what should be and reality. Furthermore it is important for us to have possibility of retrospective discussion about it.
