법과 유교적 문화전통과 헌법재판

각 나라의 헌법재판제도는 저마다 고유한 사회문화적 맥락 속에 존재한다. 그러므로 헌법재판이 국민들에게 이해되고 수용될 수 있으려면 그 사회의 문화적 규범, 가치 및 언어를 어느 정도 공유하고 반영하여야 한다. 반면 헌법재판제도는 적극적으로 사회의 문화를 변화시키기도 한다. 이 글은 우리나라의 유교적 문화전통과 헌법재판소 및 헌법재판제도의 상호작용에 대한 일 고찰이다. 먼저 우리나라 법을 유교문화와의 관련 속에서 연구하는 것이 가지는 의미에 대하여 일반론 수준에서 살펴본 후, 대한민국의 헌법재판제도를 이해하고 해석하는 데 있어서 유교문화라는 개념적인 틀의 유용성에 대하여 논하고자 한다. 후반부에서는 헌법재판소가 유교에 대하여 내린 몇 개의 결정들을 통해서 헌법재판제도가 대한민국 사회 내에서 유교전통이 가지는 문화적인 함의를 확인하거나 바꾸고 때로는 희석시키는 과정을 살피기로 한다. 동성동본금혼, 가정의례, 간통죄, 호주제, 그리고 직계존속에 관한 형사법규정들에 관하여 판단함으로써 헌법재판소는 현재 한국사회에서 유교전통이 갖는 위상과 지위에 대한 국민적 담론에 참여한 셈이다. 결국 이들 결정은 우리나라에서 가족을 어떻게 재해석ㆍ재구성할 것인가에 대한 문제의식을 갖게 한다는 데서 그 문화적인 의의를 찾을 수 있을 것이다.
Abstract
Constitutional adjudication in any country necessarily takes place in a certain cultural context. In order to make sense to its audience, constitutional adjudication must partake of the cultural signs, symbols, and value judgments. Yet, constitutional adjudication sometimes exerts an influence on the cultural context. This article examines the interaction between Confucian culture in Korea and the Constitutional Court. It begins by examining in general terms what it means to study (Confucian) culture in relation to (Korean) law. Then, it discusses the way in which Confucian culture might provide the framework for interpreting and defining the meaning of constitutional adjudication in Korea. Next, it analyzes a number of cases decided by the Korean Constitutional Court to show how constitutional adjudication affects and alters the meaning of Confucian culture in modern Korean society. The decisions on marriage prohibition, family rituals, punishment of adultery, head of the household system, and patricide and other criminal rules regarding direct ascendants all turned the Constitutional Court into an interlocutor in the wider cultural debate on the meaning of Confucianism in Korea. It ends with some thoughts on what these cases mean for the project of rethinking the meaning and structure of family in modern Korea.
