초록
표현의 자유는 국민이 의사를 자유롭게 표현하여 여론을 형성하므로 민주국가에서 필수불가결한 권리이지만 이를 무제한적으로 인정할 경우 개인의 명예권을 침해할 수 있고 이에 따라 표현의 자유와 개인의 명예권 충돌에 관한 문제가 발생할 수 있다. 최근 사이버스페이스(Cyberspace)가 등장하면서 표현의 자유에 많은 영향을 미치게 되었다. 인터넷은 표현을 촉진시키는 매체로서 일상생활 속의 필수적인 통신 및 정보공유수단으로 자리잡게 되었고, 특히 인터넷의 쌍방향성, 익명성, 다양성 등의 특성으로 인해 표현의 자유에 대한 논의에도 여러 가지 새로운 문제점들을 주고 있다. 인터넷을 통하여 수많은 정보를 신속하게 접하여 자신의 의견을 표현하는 긍정적인 측면이 있는 반면 인터넷을 통한 정보의 공유와 의사소통이 활성화될수록 인터넷으로 인하여 저작권 등의 지적재산권의 침해 및 명예훼손의 문제 등 부정적인 측면도 있다. 여러 유형의 문제 가운데 표현의 자유와 명예권의 충돌에 관해 살펴보고자 한다. 또한 인터넷 명예훼손행위에 대한 처벌규정이 기존의 고전적 매체로 인한 명예훼손행위 처벌규정과 다른점을 살펴보며 표현의 자유 한계문제에 대해 검토하고자 한다. 즉 기존의 언론 매체에서의 명예훼손 법리를 먼저 살펴보고, 이러한 명예훼손 법리가 인터넷 이라는 새로운 매체의 등장과 함께 어떻게 변화될 수 있는지의 문제를 다루게 될 것이다. 인터넷은 신속한 정보공유와 자유로운 의사소통을 가능하게 하므로 인터넷 표현행위에 관한 국가의 과도한 규제와 간섭은 인터넷 이용자들의 표현의 자유를 위축시키는 효과를 발생시킬 수 있다. 그러나 인터넷의 특성상 개인의 명예를 훼손하는 것과 같이 악용될 경우 피해가 심각할 수 있으므로 표현의 자유와 개인의 명예보호간의 적절한 조화를 이룰 수 있는 합리적이고 명확한 법의 제도와 정비가 필요하다.
Abstract
Although the freedom of expression is the indispensable right in democratic country since the people forms public opinion by freely expressing their opinions, unlimited acknowledgement of such right may infringe the right of the respect of individuals and, accordingly, issues of the conflict of the freedom of express and the respect of individuals may occur. The recent emergence of the cyberspace has imparted enormous effect on the freedom of expression. The internet has established itself as an essential means of communication and information sharing as a medium that promotes expressions. In particular, the characteristics of the internet including the bi-directionality, anonymity and diversity, etc. gave rise to various new issues in the debate on the freedom of expression. While there is the affirmative aspect of the internet of expressing individual’s opinion by quickly accessing countless amount of information, there is also the negative aspect of the internet of expansion of the problems of infringement of the intellectual property rights including copyrights and defamation, etc. as sharing of information and communication through the internet are becoming more activated. In this Study, the conflict between the freedom of expression and the respect of individuals, among various types of problems, will be examined. In addition, the issue of the limitation of the freedom of expression will be reviewed by examining how the disciplinary regulations on the defamation actions on the internet differ from those on the defamation actions on the existing classical media. That is, the principles of the laws on defamation in the existing press media will be examined first, and the issue of how such principles of the laws on defamation can be changed due to the emergence of a new medium, the internet, will be dealt with. Since the internet enables quick sharing of information and free communication, government’s excessive regulations and intervention on the expressive actions in the internet can generate the effect of constricting the freedom of expression of the internet users. However, there is a need for rational and definitive legal system and organization since the abuse of the internet such as the defamation of personal reputation can induce serious damages given the characteristics of the internet.
