“The Act on special cases concerning the execution of fine defaulters’ community service work” has been entered into force since September 26, 2009. As imprisonment in a workhouse on fine default implies fine changing into punishment of restricting physical freedom, it can be assumed that the economic inequality causes punishment inequality as a side effect. The Act of community service order, an alternative of imprisonment in a workhouse on fine default, mitigates the side effect. Therefore, the Act needs to be used even more positively. However, the majority of fine defaulters are still being imprisoned in workhouse instead of using the Act because there are several practical hardships using the Act. Following four suggestions are development plans to make the best use of the Act as an alternative of imprisonment in a workhouse. First, the maximum fine price for requesting the Act needs to be extended up to 5 million won from current 3 million won. Second, 8 hours per day of community service needs to be decreased into 6 hours per day. Third, for the recipients’ maintenance of living, community service order has to be executed during night time and holidays include weekend, rather than day time and week days. Also, transportation expenses and meal benefits needs to be offered to the recipients for their living.
