출퇴근재해의 인정근거와 판례분석을 통한 합리적인 방안 도출

최근 정부는 노동개혁의 하나로 출퇴근재해를 산재보험법으로 보호하는 내용으로 노사정 대타협을 이룬 바 있으며, 현재 출퇴근재해와 관련하여 국회에 입법발의안이 제출된 상태이다. 하지만 아직도 출퇴근재해를 산재보험법상의 업무상재해에 포함하여 보호할 것인지, 아니면 출퇴근에 대한 사용자의 지배관리가 적고 출퇴근의 경로와 방법 등에 대한 근로자 개입여지가 크다는 점을 감안하여 통상의 업무상 재해와는 달리 규정해야 할 것인지에 대한 논란은 수그러들지 않고 있다. 이러한 현실을 감안하면, 출퇴근 재해를 산재보험법상 업무상 재해로 포함할 것인지, 별도의 재해보상영역으로 할 것인지에 대한 논의에 있어 보다 진전된 연구를 통해 합리적 결론을 도출할 필요가 있다. 본 논문은 출퇴근 재해의 산업재해 인정에 대한 사법적 판단의 한계를 벗어나 출퇴근재해인정과 관련한 문제들을 해결함에 있어 보다 구체적인 출퇴근재해의 개념과 인정범위에 대한 근거를 제시함으로써 유의미한 해결을 갖도록 하고자 한다. 출퇴근은 업무수행과정이 아니며, 출퇴근 과정에 사용자의 지배관리권이 미치지 않는다는 점을 감안하면, 업무상 재해와는 다른 별도의 개념으로 규정해야 할 것이다. 하지만, 출퇴근재해를 업무상 재해와는 다른 별개의 개념으로 본다 하더라도 이의 도입은 불가피한 것인 바, 출퇴근재해 도입에 따른 제문제-출퇴근의 개념범위설정 문제(출퇴근과 관계된 통근의 전 과정(사업장과 주거지 사이를 왕복하는 과정)으로 할 것인지, 순수한 출퇴근으로 한정할 것인지), 단계적 도입(출근과 퇴근의 분리 적용, 시간적 적용범위, 공간적 적용범위, 교통수단별 도입, 사업규모별 도입순서 확정 등)방안이 제시될 수 있을 것이다.
Abstract
Recently, the government has greatly associated among tripartite-workers’ representative, enterprises’ representative and government representative-about issues related to commuting accidents. Currently, the National Assembly has been submitting proposals relating to commuting accidents. However, it is still continuing the debate whether the commuting accidents is included occupational accidents on the Industrial Accident Compensation Insurance Act or not. Considering this points, it will have a greater discussion about the question relating to the commuting accidents-whether the commuting accidents is included occupational accidents on the Industrial Accident Compensation Insurance Act or not. This study will try to solve issues related to commuting accidents-the concept of commuting accidents and recognition ranges. Commuting accidents should be defined as separate and distinct from the concept of Occupational accidents. Because commuting is not performing the employer's business and there is little employer involvement in it. However, it is inevitable to protect including the commuting accidents to the industrial accident. We will have to consider carefully the various issues of the introduction of commuting accidents-the concept of commuting accidents and the scope of protection, step-by-step introduction plan, etc.
