연안여객선 운송약관의 법적 쟁점에 관한 고찰 - 관련 행정규제의 내용 및 약관상 문제의 해결을 위한 상법 규정의 개정론을 포함하여 -

최근 우리나라에서도 연안여객선에 의한 여객의 운송이 점차 증가하고 있다. 해상여객운송계약은 해상여객운송사업자가 제시하는 ‘운송약관’에 의하여 체결되는 것이 일반적이다. 우리나라에서는 「해운법」에 의하여 해상여객운송사업자의 운송약관을 규율하고 있는데, 과거에는 인가주의였다가 1999년부터는 자유주의로 변경되었다가 2013년부터는 신고주의로 바뀌어 규제하고 있다. 실무적으로는 대부분의 연안여객운송사업자는 한국해운조합에서 성안한 「연안여객선 운송약관」을 거의 그대로 신고하여 사용하고 있다. 연안여객선에 의한 여객의 운송에 관한 관심과 그 사용빈도가 올라가고 있음에 반하여 우리나라 상법의 규정은 1962년 상법제정 당시의 여객운송에 관한 규정을 거의 그대로 사용하고 있고, 해상여객운송과 관련된 1974년 해상 여객 및 수하물의 운송에 관한 아테네 협약(이하 아테네 협약)은 가입 또는 비준하지 않고 있는 상태이다. 따라서 우리나라의 해상여객운송 관련 법규는 상당히 낙후된 상태로 평가될 수 있을 것이다. 이 논문에서는 우선 연안여객운송계약에서 사용되는 운송약관에 대한 우리나라의 행정적 규제방법의 변화와 이의 적절성에 관하여 연구하였다. 이어서, 실제로 많이 사용되는 한국해운조합의 「연안여객선 운송약관」에서 법적으로 쟁점이 되는 사항을 자세히 고찰하고 이러한 법적 문제 해결을 위한 상법 규정의 개정에 관한 의견을 제시하고 있다.
Abstract
In recent years, domestic carriage of passenger by sea has gradually increased. Most of domestic carriage of passenger by sea contract use the conditions which offered by carrier. The conditions of domestic carriage of passenger by sea are regulated by Marine Transportation Act since 1963. The early days, domestic carrier should receive certification for their conditions of domestic carriage of passenger by sea, but since 2013, domestic carrier should register their conditions. As a matter of fact, most domestic carriers use the conditions of domestic carriage of passenger by sea which made by Korea Shipping Association. The article 817 to 826 of the Korean Commercial Code(KCC) regulate the carriage of passenger by sea. That articles has less amended since 1962 when KCC is first established. Korea does not make signing nor ratification of Athens Convention relating to the Carriage of Passengers and their Luggage by Sea 1974. In my opinion, the current KCC is inadequate to modern carriage of passenger by sea, so it should be amended. In this paper, firstly, the author examine Korean administrative regulations on the conditions of domestic carriage of passenger by sea. Secondary, the author analyze legal issues of the conditions of domestic carriage of passenger by sea, and suggest some amendment of the Korean Commercial Code to solve the legal problems.
