지방자치의 본질과 자치입법권에 관한 재고찰

초록
본고는 지방자치의 본질과 헌법적 보장의 성격 등에 대한 이론적 분석을 토대로 자치입법권의 범위와 한계를 중심으로 향후 지방자치의 민주적 발전을 위한 바람직한 방향을 고찰하였다. 특히 헌법 제117조 제1항에서 규정하고 있는 조례제정권이 지방자치법 제22조 단서에 의해 과도하게 제한되고 있는 것은 아닌지의 문제점에 대해서는 위헌설의 입장에서 합리적 해결을 모색할 수 있다는 점을 강조하였고, 나아가 바람직한 지방자치의 구현을 위한 헌법정책적 차원의 개선노력의 일환으로 헌법 제117조 제1항의 “법령의 범위 안에서”를 “법률의 범위 안에서” 또는 “법률에 저촉되지 아니하는 범위 안에서”로 개정하여 자치입법권을 강화하는 방향으로 나아가는 것이 바람직하다는 점도 언급하고 있다. 이러한 방향 제시는 지방자치의 본질과 기능에 대한 올바른 헌법적 이해로부터 도출되었다. 즉, 지방자치제도가 국가로부터 위임받은 통치권(특히, 행정권)을 단순히 행사하는 통치구조로 파악할 것이 아니라, 국민의 기본권을 최대한 보장하기 위한 통치시스템(국가 및 지방자치단체)의 일부로 이해함으로써, 기존의 이른바 ‘입법적 지방자치’를 극복하고 ‘입헌적 지방자치’로 나아갈 수 있다는 점이 강조되어야 할 것이다. 이와 같이 주민들의 기본권을 최대한 보장하기 위해서는 지방자치단체가 보다 가까운 거리에서 신속하고 적절하게 주민들의 기본권실현욕구를 충족시켜 줄 수 있어야 할 것이고, 이를 위해 자치입법권의 자율성은 훨씬 강화되어야 할 것이다.
Abstract
It is well known that there are lots of reasons that the Korean local government system has not been appropriately worked. One of them is inadequate legislations(including Korean Constitution and Self-Governing Law) concerning Korean local government system, especially insufficient Korean Constitution provisions for local government system. Futhermore another problem is that the essential and the conceptual elements on the local government system are not clearly analyzed yet. Therefore, this article reviews the nature of local government system and its institutional guarantee in the Korean Constitution system, studies scope of self-governing legislation power, and then addresses the constitutional revision of the local government system as the task of Korean consitutional guarantee of local government system, laying emphasis on the feature of local government system as a ruling structure for guaranteing fundamental rights of the people as much as possible.
