우리나라는 외국인(이민자)과 관련한 사회적 이슈가 생기면 국가장래와 사회변화를 고려하는 거시적이고 종합적인 이민법률 체계를 만들기보다는 정부부처의 이기주의와 영합하여 관련 법률을 제정 또는 개정하는 실정이다. 특히 이민자 통합에 관하여는 사회적공론화와 합의가 충분히 이루어지기 전에 다문화가족지원법을 제정하여 다문화가족정책이 일방적인 퍼주기식 지원을 한다는 비판과 함께 이미 대한민국 국적을 취득하여 국민이 된 이민자들을 다문화가족 또는 결혼이주여성 등으로 범주화함으로써 대한민국 국민으로서 법적 정체성과 사회통합에 오히려 혼란을 초래하는 등 문제를 안고 있다. 우리나라보다 앞서 이민문제를 경험한 나라들은 이민이 저출산⋅고령화의 대안, 새로운 경제주체 등 국가경쟁력과 밀접하게 연계되어 있음을 직시하고 ‘선별적 이민제도’와함께 ‘이민자 통합정책’을 이민법률 체계에 포섭하여 체계적으로 운영하고 있다. 이들 국가들이 이민자(외국인) 개인의 능력과 자질을 평가하여 유입한 이민자를 어떻게 통합하는지 외국의 이민법률 체계를 분석함으로써 향후 우리나라의 이민법률 체계의 나아갈 방향을 제시하고자 한다.
Abstract
When South Korea Governments confront the social issues on foreigners(immigrants), they, without establishing a comprehensive and general immigration legal system for the nation’s future and social change, usually enact new laws or revise relating laws with the ministerial egoism. Especially in respect of migrant integration policy, the Multicultural Family Support Act caused confusion in integrating migrants and revealing their identity as nations by categorizing naturalized migrants into ‘multicultural family’ or ‘female migrants’. And the multicultural family policy was criticized for being too generous supports to the migrants. Some advanced countries experienced the migration issues ahead of South Korea recognize the benefits of migration that closely connect the improvement of the national competitiveness, such as an alternative of ageing population and low birthrate, and the inflow of new economic players. Then they systematically implement ‘the migration integration policy’ with ‘the selective immigration system’ in a migration legal system. This study comes up with some directions for a immigration legal system to the right path to the future by analyzing how the migration legal system of the foreign countries integrates immigrants into the communities through evaluating the individual qualification and competence.
